Using Arabic and Ottoman Turkish sources drawn from three genres of legal text, this book is the first full-length study in decades to investigate the evolution of Ottoman land law from its classical articulation in the sixteenth century to its reformulation in the 1858 Land Code. The book demonstrates that well before the nineteenth century the tradition of Ottoman land tenure law had developed an indigenous form of property right that would remain intact in the Land Code. In addition, the rising consensus of the jurists that the sultan was the source of the land law paved the way for the wider legislative authority that the Ottoman state would increasingly assert in the Tanzimat period of reform. Demonstrating the profound and ongoing adaptation of a legal tradition that was at once both Ottoman and Islamic, it revises our understanding of the relationship between the modern Islamic world and its early modern past, and what kind of intervention was represented by reform in the 19th century.

What can and can't be copied is a matter of law, but also of aesthetics, culture, and economics. The act of copying, and the creation and transaction of rights relating to it, evokes fundamental notions of communication and censorship, of authorship and ownership - of privilege and property. This volume conceives a new history of copyright law that has its roots in a wide range of norms and practices. The essays reach back to the very material world of craftsmanship and mechanical inventions of Renaissance Italy where, in 1469, the German master printer Johannes of Speyer obtained a five-year exclusive privilege to print in Venice and its dominions. Along the intellectual journey that follows, we encounter John Milton who, in his 1644 Areopagitica speech 'For the Liberty of Unlicensed Printing', accuses the English parliament of having been deceived by the 'fraud of some old patentees and monopolizers in the trade of bookselling' (i.e. the London Stationers' Company). Later revisionary essays investigate the regulation of the printing press in the North American colonies as a provincial and somewhat crude version of European precedents, and how, in the revolutionary France of 1789, the subtle balance that the royal decrees had established between the interests of the author, the bookseller, and the public, was shattered by the abolition of the privilege system. Contributions also address the specific evolution of rights associated with the visual and performing arts. These essays provide essential reading for anybody interested in copyright, intellectual history and current public policy choices in intellectual property. Shakespeare's Domestic Economies explores representations of female subjectivity in Shakespearean drama from a refreshingly new perspective, situating The Taming of the Shrew, The Merry Wives of Windsor, Othello, and Measure for Measure in relation to early modern England's nascent consumer culture and competing conceptions of property. Drawing evidence from legal documents, economic treatises, domestic manuals, marriage sermons, household inventories, and wills to explore the realities and dramatic representations of women's domestic roles, Natasha Korda departs from traditional accounts of the commodification of women, which maintain that throughout history women have been "trafficked" as passive objects of exchange between men. In the early modern period, Korda demonstrates, as newly available market goods began to infiltrate households at every level of society, women emerged as never before as the "keepers" of household properties. With the rise of consumer culture, she contends, the housewife's managerial function assumed a new form, becoming increasingly centered around caring for the objects of everyday life—objects she was charged with keeping as if they were her own, in spite of the legal strictures governing women's property rights. Korda deftly shows how their positions in a complex and changing social formation allowed women to exert considerable control within the household domain, and in some areas to thwart the rule of fathers and husbands.

Who was Althusius, and why is the work of a seventeenth- century political theorist important in modern times? Johannes Althusius (1557-1638) was a political theorist and a combative city politician who defended the rights of small communities against territorial absolutism. He designed a system of politics in which sovereignty would be shared and jointly exercised by a plurality of collectivities, spatial as well as social, on the basis of mutual consent and social solidarity. Early Modern Concepts for a Late Modern World places Althusius in the context of his times and explains the main features of his political thought. It also suggests, perhaps most significantly, why his theories continue to resonate today. Hueglin’s use of sources is thorough and scrupulous. He has worked in depth in Germanic scholarship and this access to German-language sources, some of which are almost unknown to the English-speaking world, provides a new interpretation of Althusius’ theory. With its emphasis on pluralized governance, negotiated compromise instead of majority rule, and the inclusion of the economic sphere into the political, Althusius’ theory belongs to a countertradition in Western political thought. Although it was written at the beginning of the modern age of sovereign politics, it applies to today’s search for a post-sovereign system of politics.
