Immer wieder gibt es Ansprüche an den Boden, die zwar nachvollziehbar sind, mit den verfassungsrechtlichen Zielen der haushälterischen Bodennutzung und Trennung von Baugebiet und Nichtbaugebiet aber kaum vereinbar sind. Kompensationsmechanismen bieten in solchen Situationen eine Handhabe, um gewisse Tätigkeiten dennoch zu ermöglichen. Kompensationsmechanismen haben sich heute in verschiedenen Teilbereichen des Raumplanungsrechts etabliert, so namentlich im Zusammenhang mit der Inanspruchnahme von Fruchtfolgeflächen sowie bei der Einzonung ohne Bedarfsnachweis. Im Rahmen der zweiten Etappe der RPG-Revision soll zudem mit dem sog. „Planungs- und Kompensationsansatz“ für Bauten und Anlagen ausserhalb der Bauzone ebenfalls ein Kompensationsmechanismus eingeführt werden. Neben Chancen birgt dies jedoch auch Risiken.

This Open Access book, building on research initiated by scholars from the Leiden-Delft-Erasmus Centre for Global Heritage and Development (CHGD) and ICOMOS Netherlands, presents multidisciplinary research that connects water to heritage. Through twenty-one chapters it explores landscapes, cities, engineering structures and buildings from around the world. It describes how people have actively shaped the course, form and function of water for human settlement and the development of civilizations, establishing socio-economic structures, policies and cultures; a rich world of narratives, laws and practices; and an extensive network of infrastructure, buildings and urban form. The book is organized in five thematic sections that link practices of the past to the design of the present and visions of the future: part I discusses drinking water management; part II addresses water use in agriculture; part III explores water management for land reclamation and defense; part IV examines river and coastal planning; and part V focuses on port cities and waterfront regeneration. Today, the many complex systems of the past are necessarily the basis for new systems that both preserve the past and manage water today: policy makers and designers can work together to recognize and build on the traditional knowledge and skills that old structure embody. This book argues that there is a need for a common agenda and an integrated policy that addresses the preservation, transformation and adaptive reuse of historic water-related structures. Throughout, it imagines how such efforts will help us develop sustainable futures for cities, landscapes and bodies of water.

Der Kommentar ist von Prof. Dr. Aldo Zaugg † begründet und in zwei Auflagen (1987 und 1995) herausgegeben worden. Prof. Dr. Peter Ludwig, ehemals Präsident des bernischen Verwaltungsgerichts und langjähriger nebenamtlicher Bundesrichter, hat ihn für die dritte und vierte Auflage (2007 bzw. 2013) und nun für die fünfte Auflage (2020) vollständig überarbeitet und nachgeführt. Der Kommentar ist ein Standardwerk zum Baugesetz und seinen Nebenerlassen (Bauverordnung, Baubewilligungsdekret usw.). Er ist seit je her sowohl bei Juristen als auch bei Laien sehr beliebt. Der Kommentar bezieht die übrigen für das Bau und Planungsrecht wesentlichen Erlasse mit ein, so insbesondere die Bundesgesetze über Raumplanung, Umweltschutz, Natur- und Heimatschutz, Gewässerschutz sowie Zweitwohnungen, ferner die bernischen Gesetze über See- und Flussufer, Strassen, Wasserbau und Wald. This book has been initiated by the workshop on Cultural heritage in changing landscapes, held during the IALE (International Association for Landscape Ecology) European Conference that started in Stockholm, Sweden, in June 200 1 and continued across the Baltic to Tartu, Estonia, in JUly. The papers presented at the workshop have been supported by invited contributions that address a wider range of the cultural heritage management issues and research interfaces required to study cultural landscapes. The book focuses on landscape interfaces. Both the ones we find out there in the landscape and the ones we face while doing research. We hope that this book helps if not to make use of these interfaces, then at least to map them and bridge some of the gaps between them. The editors wish to thank those people helping us to assemble this collection. First of all our gratitude goes to the authors who contributed to the book.
