Las hipotecas multidivisa comenzaron a comercializarse en España sobre todo durante los años 2007 y 2008 con la promesa de un interés mucho más bajo; el contexto económico existente durante dicho periodo, hizo que fueran especialmente atractivas por los elevadísimos niveles del Euribor y por la fuerte apreciación del euro respecto a otras divisas como el yen japonés o el franco suizo.Para poder colocar estos productos, se mencionaban las ventajas de reducir el tipo de interés, pero nada se apuntaba sobre el riesgo de apostar contra la devaluación del euro cuando la crisis ya era una realidad.Las entidades bancarias se dedican profesionalmente a la actividad de prestar dinero, de manera que tienen como contraparte en este tipo de contratos a muchos consumidores. Su posición es claramente desigual, y esa posición de superioridad es contemplada y tenida en cuenta por los Tribunales que se ha pronunciado, en aras de impedir el abuso o el ejercicio de derechos de manera ilícita. De hecho, la Jurisprudencia han reconocido que las hipotecas con cláusula multidivisa son productos complejos difíciles de entender y de alto riesgo por sus potenciales efectos económicos.En la presente monografía, nos hemos propuesto realizar un análisis de las resoluciones, tanto nacionales como las dictadas por el Tribunal de la Unión Europea, para finalmente ofrecer una evaluación del conjunto de la situación jurisprudencial.

Studies credit ratings on subprime and Alt-A mortgage-backed-securities (MBS) deals issued between 2001 and 2007, the period leading up to the subprime crisis. The fraction of highly rated securities in each deal is decreasing in mortgage credit risk; ratings contain useful info. for investors. There was also evidence of significant time variation in risk-adjusted credit ratings, incl. a progressive decline in standards around the MBS market peak between 2005 and mid-2007. Conditional on initial ratings, they observe underperformance (high mortgage defaults and losses and large rating downgrades) among deals with observably higher risk mortgages based on a simple ex ante model and deals with a high fraction of opaque low-documentation loans.
