El nuevo terrorismo de DAESH ha traído consigo un nuevomodus operandi, el cual ha obligado a la comunidad internacional en general y a los Estados en particular, a adaptar sus ordenamientos jurídicos para combatirlo. Uno de estos cambios se ha visto inspirado en la prevención de los llamados “lobos solitarios” o “terroristas autónomos”, enfocado principalmente en el proceso de radicalización. Es así como, en 2015, la LO 2/2015 de 23 de noviembre introduce en el Código Penal español el polémico tipo delictivo conocido como “delito de autoadoctrinamiento terrorista” en su artículo 575.2 CP. La doctrina científica ha denunciado la peligrosidad que supone este delito para el Derecho Penal de garantías, llegando a afirmar que se trata una manifestación del Derecho Penal de Autor, identificándose con un Derecho Penal simbólico y destacando por su adelantamiento injustificado de las barreras de punibilidad y; por ende, afirmándose como un Derecho Penal del Enemigo. Esta obra trata de analizar el tipo objetivo y subjetivo del delito de “autoadoctrinamiento” terrorista, dando respuesta a su compatibilidad con el Estado de Derecho, sus principios político-criminales, los Derechos Fundamentales y las Libertades Públicas. A partir de este estudio, se pondrán de manifiesto los principales problemas que acarrea dicho tipo delictivo y las consecuencias que supone la doctrina judicial y científica que se ha adoptado.
