The Social Dynamics of Open Data is a collection of peer reviewed papers presented at the 2nd Open Data Research Symposium (ODRS) held in Madrid, Spain, on 5 October 2016. Research is critical to developing a more rigorous and fine-combed analysis not only of why open data is valuable, but how it is valuable and under what specific conditions. The objective of the Open Data Research Symposium and the subsequent collection of chapters published here is to build such a stronger evidence base. El elemento político en los crímenes contra la humanidad. La expansión de la figura al crimen organizado transnacional y el caso de las organizaciones de narcotraficantes mexicanas en el sexenio 2006-2012 estudia, a partir de las características de los crímenes contra la humanidad, si algunas organizaciones criminales son idóneas para promover este crimen internacional. Para ello, analiza los requisitos del término “organización” según el artículo 7.2 a) del Estatuto de Roma. El análisis se ejemplifica con determinadas situaciones en Colombia, Guatemala y, más a fondo, México. El primer capítulo aborda el tipo penal de los crímenes de lesa humanidad, especialmente su elemento político y los rasgos del colapso estatal, término novedoso y derivado de la necesidad de describir en qué grado de estabilidad o crisis se encuentra el Estado donde se comete presuntamente dicho crimen internacional. El segundo capítulo caracteriza la figura de la criminalidad organizada transnacional a partir de la Convención de Palermo. Se completa con el análisis de dos tipos de organizaciones criminales problemáticas para la gobernabilidad como las Bandas Criminales colombianas y los Cuerpos Ilegales y Aparatos Clandestinos de Seguridad guatemaltecos. Con ello, se logran instrumentos teóricos para responder a las cuestiones del capítulo final: Cuál es la naturaleza de las principales organizaciones de narcotraficantes mexicanas que operaron en el sexenio 2006-2012 y qué dificultades plantea considerarlas organizaciones en el sentido del artículo 7.2. a) del Estatuto de Roma. Jesús Pérez Caballero (Gandía, 1981) es Doctor en Seguridad Internacional por el Instituto Universitario General Gutiérrez Mellado de la UNED (Madrid). Licenciado en Derecho por la Universidad de Valencia y en Periodismo por la Universidad Carlos III de Getafe (Madrid), reside en Guadalajara (Jalisco, México), donde es investigador independiente sobre temas de crimen organizado, narcotráfico y Derecho Penal en Latinoamérica.
