Trabajo Universitario del año 2010 en eltema Derecho - Derecho público / Derecho constitucional / Derechos fundamentales, Nota: 1, Universidad de Cádiz (-), Materia: Máster en Género, Identidad y Ciudadanía, Idioma: Español, Resumen: Este trabajo pretende incitar una reflexión crítica sobre el sistema legal alemán y más concretamente sobre aquellas leyes que fomentan la igualdad o defienden a la mujer y sus derechos en este país, que son prácticamente inexistentes o están ancladas en reformas antiguas e ineficaces, como argumentaré a continuación. En el caso de la legislación española al respecto, el artículo 14 de la Constitución Española de 1978 proclama el derecho a la igualdad y a la no discriminación por razón de sexo. El artículo 9.2 resume la obligación de los poderes públicos de promover las condiciones para que la igualdad del individuo y del grupo sea real y efectiva. Por otra parte, los últimos años han sido testigo de un gran avance legislativo en cuanto a leyes que promuevan la igualdad de género y penalizan la violencia hacia la mujer en nuestro país. Entre ellas me gustaría destacar la Ley Orgánica 3/2007, de 22 de Marzo, para la Igualdad efectiva de mujeres y hombres y la Ley Orgánica 1/2004, de 28 de Diciembre, de medidas de protección integral contra la violencia de Género. Sin embargo, Alemania, habiendo sido durante las ultimas décadas un ejemplo de democracia, crecimiento y economía sostenible para la Unión Europea, está desprovista de un entramado legal que verdaderamente fomente la igualdad y defienda los derechos de la mujer alemana. Me gustaría reflexionar sobre este tema a partir de un estudio de las leyes pertinentes a lo largo de las últimas décadas. Para ello me centraré en reformas del Código Penal y en las siguientes leyes: - Grundgesetz für die Bundesrepublik Deutschland - Gleichberechtigungsgesetz, Gesetz über die Gleichberechtigung von Mann und Frau auf dem Gebiet des bürgerlichen Rechts - Gewaltschutzgesetz o Gesetz zum zivilrechtlichen Schutz vor Gewalttaten und Nachstellungen - Anti-Stalking Gesetz, Gesetz zur Strafbarkeit beharrlicher Nachstellungen
