Maritime Piracy is now a pressing global issue, and this work seeks to provide a concise and informative introduction to the area. Somali piracy poses a threat to the UK's national interests as well as global trading routes and international security. The costs of allowing piracy to proliferate are high. The British shipping industry is worth £10.7 billion to the UK's GDP, and the costs of security, insurance, re-routing have vastly increased the costs of doing business. Over $300 million has been paid in ransoms to Somali pirates over the past four years, and thousands of seafarers have been held hostage, some of whom have been subject to cruel treatment and even torture. Self-defence measures, multi-national naval operations and prosecutions have begun to take effect, but have not yet contained the problem. The major international conference on Somalia in February 2012 must produce results. Although private armed guards will be permitted on UK shipping, the Government's guidance on the use of force, particularly lethal force, is very limited and there is little to help a ship's master make a judgement on where force can be used. The Committee also expresses surprise that so little is known about what happens to ransom money. The solution lies in establishing order on land, ending impunity for piracy crimes and offering alternatives. However, the report warns against international claims to deliver a solution in Somalia, and urges the Government to develop its engagement with and support for Somali civil society organisations and local projects. The FCO should also review its communication and other procedures to support family members of British hostages held abroad.

While successful hijackings and ransoms off the coast of Somalia have recently receded, the inability of the international community to provide an effective and consistent legal deterrent to pirate activity remains. The prevailing policy of “catch and release” enables pirate activity to persist in international waters - allowing criminals to roam the seas as a constant threat to commercial shipping and with a sense of impunity. The text herein explores the weaknesses of the international legal regime in combating maritime piracy, focusing on the inability and unwillingness of states to prosecute captured pirates under universal jurisdiction.This essay highlights that one of the greatest impediments to prosecutions is a lack of legal capacity by states to charge and punish individuals for the crime of piracy. An absence of domestic legislation either criminalizing piracy or providing for the exercise of universal jurisdiction directly prohibits certain nations from bringing to justice many of the pirates captured on the high seas. This thesis also presents evidentiary issues as a crucial factor in the persistence of the “catch and release” policy. Accordingly, this text explores how the adoption of “equipment articles” could mitigate some of these issues and facilitate the prosecution of maritime piracy. Furthermore, the essay directly addresses how equipment articles and domestic legislation would be added to the current international legal framework.This text first examines the relevant international law that both defines piracy and provides for its criminalization and punishment by individual states. In order to ground the successes and failures of international prosecution efforts in their all-important context, this essay also explores the characteristics of Somali piracy, including the root causes of pirate activity and the mechanics of piracy operations. Likewise, this text surveys the conventional efforts to combat piracy in the region and the interaction between naval personnel and captured piracy suspects. Additionally, this essay focuses on the legal capability of states to arrest and prosecute pirates that are captured on the high seas.While the conclusions in this essay are specifically tailored to the pirate activity off the coast of Somalia and the unique characteristics of this incidence, wider implications for the deterrence of global maritime piracy can be gleaned from the analysis and arguments herein.

Piratical attacks have become more frequent, violent, costly and increasingly threaten to undermine order in the international system. Much attention has focused on Somalia, but piracy is a problem worldwide. Recent coordination efforts among states in South East Asia appear to have helped in the area, but elsewhere piracy has expanded. Interestingly, international law has long recognized piracy as a crime and provided tools for universal suppression, yet piracy persists. In this book, a handpicked group of leading experts in the field of International Relations use maritime piracy as a means to expose the incongruities in our understanding of global governance. Using broadly constructivist approaches to understand international actors’ responses to the challenges created by maritime piracy, the contributors question a number of myths and misconceptions around piracy and analyze the various ways that international law and organizations channel actors’ understandings of maritime piracy and their efforts to respond to it. Maritime piracy's improbable re-emergence following the end of the Cold War was surprising as the image of pirates evokes masted galleons and cutlasses. Yet, the number of incidents and their intensity skyrocketed in the 1990s and 2000s off of the coasts of Indonesia, Malaysia, the Philippines, India, Bangladesh, Nigeria, and Somalia. As Ursula Daxecker and Brandon Prins demonstrate in Pirate Lands, Maritime piracy-like civil war, terrorism, and organized crime-is a problem of weak states. Surprisingly, though, pirates do not operate in the least governed areas of weak states. Daxecker and Prins address this puzzle by explaining why some coastal communities experience more pirate attacks in their vicinity than others. They find that pirates do well in places where elites and law enforcement can be bribed, but they also need access to functioning roads, ports, and markets. Using statistical analyses of cross-national and sub-national data on pirate attacks in Indonesia, Nigeria, and Somalia, Daxecker and Prins detail how governance at the state and local level explain the location of maritime piracy. Additionally, they employ geo-spatial tools to rigorously measure how local political capacity and infrastructure affect maritime piracy. Piracy is a basic and fundamental concern for all navies. From almost the beginning of state-sponsored navies, piracy suppression has been one of their major responsibilities -- when Julius Caesar was captured by pirates in 76 BCE, the first thing he did after paying the pirates' ransom and being released was to fit "out a squadron of ships to take his revenge." Despite piracy's importance and the continued frequency of piratical attacks, however, relatively few scholarly works have been written analyzing cases of modern piracy and piracy suppression in terms of varying strategic, policy, and operational decisions. This edited collection of case studies attempts to fill this gap. There have been a number of important historical studies that have dealt with the subjects of piracy and piracy suppression. Books written from the point of view of those wishing to end piracy have tended to focus on legal issues, including the rights of victims, the procedures and decisions of Admiralty courts in punishing pirates, and the capture of piracy ships as prizes. Others have looked at the existence of piracy in terms of one particular place or time period, with the Barbary Coast and the Caribbean Sea claiming disproportionate shares of attention. Pirates are often romanticized; Forbes magazine has recently listed history's top-earning pirates, including Samuel "Black Sam" Bellamy at US$120 million (2008 dollars), Sir Francis Drake at US$115 million, and Thomas Tew at US$103 million. More famous pirates, like Edward Teach (Blackbeard), came in far down the list, at tenth place, with only US$12.5 million.
