A responsabilidade civil, a partir da segunda parte do século passado, sofreu forte evolução pormeio da reelaboração de seus conceitos e finalidades ante a nova realidade imposta pelas profundas modificações introduzidas pela revolução industrial no seio da sociedade. Nesse quadro, foi concebida a responsabilidade objetiva extracontratual que não se amoldavaao clássico sistema oitocentista que deitava suas raízes no Direito Romano e fundava-se, em regra, na culpa, a qual, até então, era o principal objeto de estudo da doutrina e jurisprudência no campo da responsabilidade civil. Neste estudo procuramos evidenciar os motivos determinantes do surgimento da responsabilidadeobjetiva extracontratual e a busca científica de seufundamento, e pressupostos que entendemos ser o fato lesivo e o dano; afastando-se, por vezes, da doutrina e jurisprudência dominantes que insistem em erigir apenas a teoria do risco ao centro de qualquer prospecção no âmbito desse institutojurídico.
