The Code of Good Practice in Electoral Matters, which was adopted by the Venice Commission in 2002, is the reference document of the Council of Europe in the electoral field. It defines in detail the standards of European electoral heritage: universal, equal, free, secret and direct suffrage, as well as the frequency of elections, including the framework conditions that are necessary for the organisation of proper elections, such as respect for human rights, particularly in the political field, the organisation of elections by an impartial body and an effective appeals system. This publication contains the reports presented at the seminar organised under the Albanian Chairmanship of the Committee of Ministers of the Council of Europe on the occasion of the 1Oth anniversary of the code. It focuses in particular on the main problems of electoral law and administration, including the composition and functioning of electoral administration, as well as the representation of women and minorities. It also refers to the importance of the code for the other Council of Europe bodies, including the European Court of Human Rights, when ensuring the right to free elections

The right to free elections is one of the most difficult rights to define: while it is an objective and essential principle in any democratic society, it is also a fundamental personal right on which every citizen can rely. This handbook, drafted in collaboration with civil society organisations from the countries of the Eastern Partnership, is a response to the recommendation set out in the 2015 report by the Secretary General of the Council of Europe entitled State of democracy, human rights and the rule of law in Europe. Its purpose is to improve the quality of domestic observation of electoral processes in the member states and to serve as a reference for domestic observers, primarily for core team members. At the same time, it may serve as a training tool for long-term and short-term observers and other electoral stakeholders who wish to familiarise themselves with international election standards (government officials, electoral administration, party representatives, judges, lawyers). The Council of Europe is convinced that this handbook will further promote the uniform application of Europe’s electoral heritage and of other international standards in its member states and beyond.

This volume includes the reports presented at the seminar on "European standards of electoral law in contemporary constitutionalism" organised by the Venice Commission in co-operation with the Constitutional Court of the Republic of Bulgaria in Sofia (Bulgaria), on 28 and 29 May 2004. After fifteen years of democratic transition in central and eastern Europe, the organisation of elections in conformity with the principles of the European electoral heritage is still a major challenge. In order to ensure the effectiveness of these principles (univeral, equal, free, secret and direct suffrage) a certain number of procedural guarantees must be respected. Firstly, elections must be organised by an impartial body in an independent and transparent manner; this is the main message in this publication. The body in charge of organising the elections should be able to ensure, without any political manipulation, that the electoral process is carried out efficiently, from the pre-election period right up to the close of any dispute regarding the results. The reports cover three aspects wich are indispensable to the impartiality of electoral commissions and equivalent bodies: independence with regard to the composition and functioning of the electoral administration; transparency and impartiality of the electoral administration on election day and after the election.

The European Commission for Democracy through Law, or Venice Commission, is the Council of Europe's advisory body on constitutional matters. It gives legal opinions on the development and operation of democratic institutions and constitutional law. The Venice Commission's work is aimed at upholding the three underlying principles of Europe's constitutional heritage: democracy, human rights and the rule of law. Since its inception, the Venice Commission has been particularly active in the field of elections, the cornerstone of democracy. This book is a compilation of the main Venice Commission texts dealing in general terms with elections and referendums. First come the reference documents: the Code of Good Practice in Electoral Matters and the Code of Good Practice on Referendums. These are followed by a judicious selection of general studies on such fundamental topics as recurrent challenges and problematic issues in electoral law in Europe, election systems, the representation of national minorities on elected bodies - through the application of general rules and specific measures - and a comparison of the legal rules on referendums in European states.
