Customary international law is a widely-recognised modality of international lawmaking. It underpins all norms of international law and shapes all aspects of global society. Yet familiar approaches to customary international law struggle to answer basic questions about its role, operation, and prospects. Pursuing an interdisciplinary approach, this book offers an alternative perspective on customary international law as a dynamic and multifaceted social phenomenon and idea. It explores customary international lawmaking in different social contexts, including the regulation of armed conflict, the treatment of the 'other', and the management of global environmental risks. Focusing on the 'varieties' of customary international law, it identifies four types of customary international law norms and explores their roles and implications. Critically revisiting a classic topic of international law, the book provides a tool for understanding and shaping global lawmaking and social change in a rapidly changing international legal order.

More than half of the world's population lives under law codes. Yet, defining the concept of codification remains elusive. Rather than delving into abstract theories, this book provides a rich and contextual comparative legal history of codes in France, Germany, the Netherlands, and Belgium from the late eighteenth century to the present. The author starts by examining the evolution of French, German, Dutch, and Belgian codes in their political and comparative context, thus challenging deeply rooted national narratives. He covers the well-studied civil codes and the often-overlooked commercial and procedural codes and drafts that failed to become law. Against this backdrop, the book embarks on a comprehensive analysis of the factors contributing to the success or failure of codification efforts. Employing an innovative method of comparative legal history, Redefining Codification explores the key players and objectives behind codification, revealing that traditional notions of codification are far removed from reality. Following the deconstruction of some 'universal truths' about codifications, this volume offers fresh insights into the behind-the-scenes of the lawmaking machinery and an empirically based definition of codification.

The Great Broadening written by Bryan D. Jones and has been published by University of Chicago Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-07-19 with Political Science categories.
Beginning in the late 1950s and continuing through the 1970s, the United States experienced a vast expansion in national policy making. During this period, the federal government extended its scope into policy arenas previously left to civil society or state and local governments. With The Great Broadening, Bryan D. Jones, Sean M. Theriault, and Michelle Whyman examine in detail the causes, internal dynamics, and consequences of this extended burst of activity. They argue that the broadening of government responsibilities into new policy areas such as health care, civil rights, and gender issues and the increasing depth of existing government programs explain many of the changes in America politics since the 1970s. Increasing government attention to particular issues was motivated by activist groups. In turn, the beneficiaries of the government policies that resulted became supporters of the government’s activity, leading to the broad acceptance of its role. This broadening and deepening of government, however, produced a reaction as groups critical of its activities organized to resist and roll back its growth.

Agenda Setting In The U S Senate written by Chris Den Hartog and has been published by Cambridge University Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2011-05-16 with Political Science categories.
Proposes a new theory of Senate agenda setting that reconciles a divide in literature between the conventional wisdom – in which party power is thought to be mostly undermined by Senate procedures and norms – and the apparent partisan bias in Senate decisions noted in recent empirical studies. Chris Den Hartog and Nathan W. Monroe's theory revolves around a 'costly consideration' framework for thinking about agenda setting, where moving proposals forward through the legislative process is seen as requiring scarce resources. To establish that the majority party pays lower agenda consideration costs through various procedural advantages, the book features a number of chapters examining partisan influence at several stages of the legislative process, including committee reports, filibusters and cloture, floor scheduling and floor amendments. Not only do the results support the book's theoretical assumption and key hypotheses, but they shed new light on virtually every major step in the Senate's legislative process.
