Sustainability and food production represent a major challenge to society, with both consumption and supply sides posing practical and ethical dilemmas. This book shows that food governance issues can occur in many ways and at many points along the food chain. The risks and impacts, particularly with the increasing globalisation of food systems, are often distributed in unequal ways. It is the role of law to form the pivot around which these issues are addressed in society in the form of food governance mechanisms. The chapters in this book address a range of issues in food governance revolving around questions of justice, fairness, equality and human rights. The Protection of Plant Varieties and Farmer’s Rights Act, 2001, promises to balance the intellectual property rights of plant breeders and farmers under one umbrella legislation. However, there remain several grey areas and the rights of farmers, in reality, are still tenuous. Though the rights framework was foregrounded on an understanding between non-governmental organizations and industry, there is lack of clarity at both conceptual and procedural levels. In this context, Sophy K. Joseph analyses the impact of legal policy reforms during the ongoing Second Green Revolution on farmers’ customary rights and livelihood. The author discusses how the extension of private property rights to plant varieties, seeds, and other agrarian resources changed the demographic composition of the rural space, with increased migration of cultivators to the cities. The book argues that the transition from state interventionism (during the First Green Revolution) to state abstention (in the Second Green Revolution) has dramatically influenced India’s conventional agrarian practices and traditions. This work maps the evolutionary process of neoliberal economic and legal policies and its interference with primary concerns such as food security, food sovereignty, and agrarian self-reliance of the country.

Taking as a starting point that hunger results from social exclusion and distributional inequities and that lasting, sustainable and just solutions are to be found in changing the structures that underlie our food systems, this book examines how law shapes global food systems and their ongoing transformations. Using detailed case studies, historical mapping and legal analysis, the contributors show how various actors (farmers, civil society groups, government officials, international bodies) use or could use different legal tools (legislative, jurisprudential, norm-setting) on various scales (local, national, regional, global) to achieve structural changes in food systems. Section 1, Institutionalizing New Approaches, explores the possibility of institutionalizing social change through two alternative visions for change – the right to food and food sovereignty. Individual chapters discuss Vía Campesina’s struggle to implement food sovereignty principles into international trade law, and present case studies on adopting food sovereignty legislation in Nicaragua and right to food legislation in Uganda. The chapters in Section 2, Regulating for Change, explore the extent to which the regulation of actors can or cannot change incentives and produce transformative results in food systems. They look at the role of the state in regulating its own actions as well as the actions of third parties and analyze various means of regulating land grabs. The final section, Governing for Better Food Systems, discusses the fragmentation of international law and the impacts of this fragmentation on the realization of human rights. These chapters trace the underpinnings of the current global food system, explore the challenges of competing regimes of intellectual property, farmers rights and human rights, and suggest new modes of governance for global and local food systems. The stakes for building better food systems are high. Our current path leaves many behind, destroying the environment and entrenching inequality and systemic poverty. While it is commonly understood that legal structures are at the heart of food systems, the legal academy has yet to make a significant contribution to recent discussions on improving food systems - this book aims to fill that gap.

Over the past two decades, existing documentation of women in the agricultural sector has surveyed topics such as agricultural restructuring and land reform, international trade agreements and food trade, land ownership and rural development and rural feminisms. Many studies have focused on either the high-income countries of the global North or the low-income countries of the global South. This separation suggests that the North has little to learn from the South, or that there is little shared commonality across the global dividing line. Fletcher and Kubik cross this political, economic, and ideological division by drawing together authors from 5 continents. They discuss the situation for women in agriculture in 13 countries worldwide, with two chapters that cover international contexts. The authors blur the boundaries between academic and organizational authors and their contributors include university-based researchers, gender experts, development consultants, and staff of agricultural research centers and international organizations (i.e., Oxfam, the United Nations World Food Program). The common thread connecting these diverse authors is an emphasis on practical and concrete solutions to address the challenges, such as lack of access to resources and infrastructure, lack of household decision-making power, and gender biases in policymaking and leadership, still faced by women in agriculture around the world. Ongoing issues in climate change will exacerbate many of these issues and several chapters also address environment and sustainability.
