The topic of the 43rd Congress of the International Institute of Public Finance was "Public Finance and the Performance of Enterprises." The title reflected profound changes in the thinking and approaches of economists traced back to economic developments such as the worldwide slowing down of economic growth, dwindling of productivity increases, growing unemployment, and rampant increase in public debt experienced during the 1970s and 80s. The Congress was not primarily concerned therefore with the economic efficiency of particular enterprises, but with the interface of Public Finance and the behavior of enterprises. The intent was to detect how fiscal policy decisions effect the behavior of enterprises and how this in turn influences the overall performance of an economy--to seek microeconomic foundations for macroeconomic relationships. This volume presents the proceedings of the 43rd Congress with papers from numerous international contributors.

The debt problems of poor countries are receiving unprecedented attention. Both federal and non-governmental organizations alike have been campaigning for debt forgiveness for poor countries. The governments of creditor nations responded to that challenge at a meeting sponsored by the G-7, International Monetary Fund, and World Bank, all of which upgraded debt relief as a policy priority. Their initiatives provided for generous interpretations of these nations' abilities to sustain debt, gave them opportunities to qualify for debt relief more rapidly, and linked debt relief to broader policies of poverty reduction. Despite this, the crisis has only deepened in the first years of the new millennium. This brilliant group of contributions assesses why this has occurred. In plain language, it considers why debt relief has been so long in coming for poor countries. It evaluates the cost of a persistent overhang in debt for those countries. It also examines, head on, whether enhanced debt relief initiatives offer a permanent exit from over-indebtedness, or are merely a short-term respite. Above all, this volume for the first time addresses the issues on the ground: that is, the views and opinions about debt relief on the part of leaders in advanced nations, and the probability of further support for the most impoverished lands. In this approach, the editors and contributors have made an explicit and successful attempt to be inclusive and relevant at all stages of the analysis. This volume covers the full range of the poorest countries, with contributions by John Serieux, Lykke Anderson and Osvaldo Nina, Befekadu Degefe, Ligia Maria Castro-Monge, and Peter B. Mijumbi. Collectively, they offer a sobering scenario: unless measures are put in place now, in anticipation of further crises, the future of the very poorest nations will remain bleak and troublesome. John Serieux completed this volume as a senior researcher and specialist in international finance for the North-South Institute, an independent research institute based in Ottawa, Canada. Before that he was a lecturer at the graduate program in economics at Chancellor College, at the University of Malawi. His major works are in domestic and foreign resource mobilization. Yiagadeesen Samy is completing his doctoral research in economics at the University of Ottawa in international trade and economics of development. His key interest is now in trade and labor standards.

This book examines legal limitations on government deficit and debt and its impact on the ability of nations to provide services to their residents. It studies constitutional and statutory limitations, as well as those imposed by international treaties and other instruments, including those of both the European Union and the International Monetary Fund. The book contains a general report examining the fiscal rules that govern the budgets and expenditures of nation states. The general report is followed by a special report which covers the limits imposed by the European Union and by the smaller group of countries constituting the Eurozone. Ten national reports, describing the limits in their respective countries, form the basis of the general report. These countries include eight members of the European Union (five of which use the Euro and three of which do not), one other European state and one non-European state. The reports include two countries in which constitutional “debt brakes” limit national deficit and debt.

This book is the result of a 4-year research project conducted at the Faculty of Law of the University of Luxembourg. It explores the legal value and enforceability of tax circulars and tax rulings in Luxembourg domestic law in light of the principle of legitimate expectations and related principles. After studying the historical roots of both interpretative acts, this research questions the level of protection taxpayers enjoy when relying on circulars and tax rulings and contains a review of decades of administrative case-law to assess the judicial discourse on taxpayers’ rights to certainty. This book further investigates the case of circulars and tax rulings that contain interpretations of tax laws that are contrary to the law (contra legem) and builds upon the existing normative framework to introduce proposals addressing issues of uncertainty and inequality taxpayers are likely to suffer when relying on such interpretative acts. The governance and evaluation of ‘megaprojects’ – that is, large-scale, complex, high-stakes infrastructure projects usually commissioned by governments and delivered through partnerships between public and private organisations – is receiving increased attention. However, megaproject evaluation has hitherto largely adopted a linear-rationalist perspective to explain the frequent failure of such projects to meet the ‘iron triangle’ of performance criteria: delivering on time, within budget, and according to specifications. This approach recommends greater control and accountability to remedy megaproject ‘pathologies’. Drawing on empirical examples mainly from the transport sector and radioactive waste disposal, this book offers new perspectives to megaproject evaluation. Comprising contributions from leading experts in project evaluation and appraisal, this collection opens up new avenues by suggesting two ways of improving megaproject evaluation: 1) approaches that go beyond the dominant linearrationalist notion of policy processes, and emphasise instead the objective of opening up appraisal processes in order to enhance learning and reflexivity; and 2) approaches that extend evaluative criteria beyond the ‘iron triangle’, to cover the various socioeconomic impacts and preconditions for project success. This volume will be of great relevance to scholars and practitioners with an interest in megaprojects, energy and climate policy, radioactive waste management, urban design, and project planning and management.
