This book demonstrates the analytical power of the concept of fragility as a central and defining aspect of global migration processes. To this end, the book brings together authors from the Americas, South Asia, the Middle East, and Europe, fostering a global dialogue on the social structuring of migration fragility in and between the Global North and the Global South. The various chapters of the book focus on two aspects. First, it discusses the multiplicity of the migrant as a social figure. There is not just one type of migrant, but a multiplicity of different fragile configurations that lead to the migrantization of people. Secondly, the same applies to the process of migration itself. There is a plethora of different articulations of fragility in crossing borders and organizing a new life somewhere else. Both perspectives show that the fragility of migration is not an aberration from “normality”. Fragility is an intrinsic part of the stabilization of social inequalities of migration between different migrants and different countries and regions of the globe. As such, this book is an important resource for researchers and students interested in the study of migration processes.

While migration has become an all-important topic of discussion around the globe, mainstream literature on migrants' legal adaptation and integration has focused on case studies of immigrant communities in Western-style democracies. We know relatively little about how migrants adapt to a new legal environment in the ever-growing hybrid political regimes that are neither clearly democratic nor conventionally authoritarian. This book takes up the case of Russia—an archetypal hybrid political regime and the third largest recipients of migrants worldwide—and investigates how Central Asian migrant workers produce new forms of informal governance and legal order. Migrants use the opportunities provided by a weak rule-of-law and a corrupt political system to navigate the repressive legal landscape and to negotiate—using informal channels—access to employment and other opportunities that are hard to obtain through the official legal framework of their host country. This lively ethnography presents new theoretical perspectives for studying immigrant legal incorporation in similar political contexts.

The Soviet Union comprehensively governed the mobility of its citizens by barring emigration and strictly regulating internal migration. International treaties, conventions, and organizations to protect refugees were established in the aftermath of World War II to protect people escaping targeted persecution by their own governments. However, the nature of cross-border displacement has transformed dramatically since then. Such threats as environmental change, food insecurity, and generalized violence force massive numbers of people to flee states that are unable or unwilling to ensure their basic rights, as do conditions in failed and fragile states that make possible human rights deprivations. Because these reasons do not meet the legal understanding of persecution, the victims of these circumstances are not usually recognized as "refugees," preventing current institutions from ensuring their protection.In this book, Alexander Betts develops the concept of "survival migration" to highlight the crisis in which these people find themselves. Examining flight from three of the most fragile states in Africa—Zimbabwe, the Democratic Republic of Congo, and Somalia—Betts explains variation in institutional responses across the neighboring host states. There is massive inconsistency. Some survival migrants are offered asylum as refugees; others are rounded up, detained, and deported, often in brutal conditions. The inadequacies of the current refugee regime are a disaster for human rights and gravely threaten international security. In Survival Migration, Betts outlines these failings, illustrates the enormous human suffering that results, and argues strongly for an expansion of protected categories.

In late summer 2015, Sweden embarked on one of the largest self-described humanitarian efforts in its history, opening its borders to 163,000 asylum seekers fleeing the war in Syria. Six months later this massive effort was over. On January 4, 2016, Sweden closed its border with Denmark. This closure makes a startling reversal of Sweden’s open borders to refugees and contravenes free movement in the Schengen Area, a founding principle of the European Union. What happened? This book sets out to explain this reversal. In her new and compelling book, Vanessa Barker explores the Swedish case study to challenge several key paradigms for understanding penal order in the twenty-first century and makes an important contribution to our understanding of punishment and welfare states. She questions the dominance of neoliberalism and political economy as the main explanation for the penalization of others, migrants and foreign nationals, and develops an alternative theoretical framework based on the internal logic of the welfare state and democratic theory about citizenship, incorporation, and difference, paying particular attention to questions of belonging, worthiness, and ethnic and gender hierarchies. Her book develops the concept of penal nationalism as an important form of penal power in the twenty-first century, providing a bridge between border control and punishment studies.
