English summary: Heike Dohrn analyzes the competences of the European Community in private international law. In her opinion the new articles 61 and 65, introduced by the Treaty of Amsterdam and slightly modified by the Treaty of Nice, give the European Community the power to establish uniform rules in all areas of private international law. In spite of its ambiguous wording and systematic inadequacy, the new competence is an expression of a further step by the European Union toward more integration. The new objective of creating an area of freedom, security and justice focuses on the individual and the protection of his/her rights. The standardization of private international law is an important part of this aim, preventing as it does forum shopping and creating legal security in cross-border private relations. German description: Der viel zitierte Saulenwechsel durch den Amsterdamer Vertrag hat die justitielle Zusammenarbeit in Zivilsachen in den EG-Vertrag verschoben und damit vergemeinschaftet. Sie ist dort zugleich Gegenstand besonderer - in Formulierung und Systematik stark umstrittener - Kompetenzvorschriften geworden, die durch den Vertrag von Nizza nochmals geringfugig weiter modifiziert wurden. Heike Dohrn stellt dar, dass sich diese Vergemeinschaftung der IPR-Rechtsetzungskompetenzen durchaus in den durch den Amsterdamer Vertrag insgesamt vollzogenen weiteren Integrationsschritt der Europaischen Gemeinschaft einfugt. Im Lichte der neuen Zielsetzung des schrittweisen Aufbaus eines Raums der Freiheit, der Sicherheit und des Rechts ist die gemeinschaftliche IPR-Kompetenz weit auszulegen. Auf ihrer Grundlage ware nunmehr die Schaffung eines universellen IPR-Gesetzes im Rahmen der Gemeinschaft moglich. Die Autorin nimmt im Ubrigen Stellung zum Verhaltnis der Art. 61, 65 EGV zu anderen Rechtsetzungskompetenzen der Gemeinschaft und spricht sich insbesondere fur ein lex specialis-Verhaltnis zu Art. 95 EGV aus. Schliesslich wird die bisherige Rechtsetzungstatigkeit der Gemeinschaft auf der neuen Rechtsetzungsgrundlage einer kritischen Prufung unterzogen.

Wenig andere Rechtsgebiete unterliegen einer derart dynamischen Entwicklung wie das europäische Privatrecht. Die systematische Durchdringung der gemeinschaftlichen Privatrechtsangleichung ist mittlerweile zentraler Gegenstand des wissenschaftlichen Dialogs. In diesem Zusammenhang beschäftigt sich die vorliegende Arbeit mit der Konkretisierung von Generalklauseln. Der Autor entwickelt systematische Lösungsansätze für die beiden grundlegenden Fragen nach den Kriterien zur Verteilung der Kompetenz zur Konkretisierung von Generalklauseln einerseits und den allgemeinen inhaltlichen Vorgaben des europäischen Privatrechts für die Konkretisierung andererseits.
