This in-depth book explores the changing role of comparative law in an era of Europeanisation and globalisation. It explains how national law coexists and interacts with supranational and international law and how legal rules are produced by a variety of institutions alongside and beyond the nation-state. The book combines both theoretical and practically oriented contributions in the areas of law and development, comparative constitutional law, as well as comparative private and economic law. It offers a plurality of perspectives on the theory and methods of comparative law as a legal discipline, but also on comparative law when concretely applied in projects of legal aid, harmonisation of law and legal reform. Offering a multi-disciplinary perspective, this book will appeal to researchers and policymakers in international organisations. It will also serve as a valuable resource for advanced level courses on comparative law, and on law reform and legal aid.

Once again, we are pleased to present this book which is the result of the conference held in Katowice in 2022 and the effect of the international cooperation between the Research Group of the Commercial Law acting at the Faculty of Law and Administration of the University of Silesia in Katowice and representatives of foreign university departments of private law from the Czech Republic, Slovakia, and Ukraine. The publication is the continuation of the international cooperation that began in 2014. The idea of the sixth collective publication was to analyze the directions of legislative changes in the field of private law in individual countries. In this edition, the entire publication consists of fourteen articles devoted to the issues of company law, commercial contract law, including the development contract, capital market issues, and bankruptcy law. This publication is dedicated primarily to civil and commercial law academics, but it also addresses the issues relevant to legal practice. The presented papers may, to a large extent, constitute material for comparative research.

It also provides stimuli for further research, exploring the idea that the comparative method offers a valuable way to enrich law and economics scholarship. With contributions from leading scholars from around the world, the Handbook sets the context by examining the past, present and future of comparative law and economics before addressing this approach to specific issues within the fields of intellectual property, competition, contracts, torts, judicial behaviour, tax, property law, energy markets, regulation and environmental agreements. This topical Handbook will be of great interest and value to scholars and postgraduate students of law and economics, looking for new directions in their research. It will also be a useful reference to policymakers and those working at an institutional level.

Representing such varied disciplines as the law, political science, sociology, history and anthropology, the contributors review the intellectual traditions that have evolved within the discipline of comparative legal studies, explore the strengths and failings of the various methodologies that comparatists adopt and, significantly, explore the directions that the subject is likely to take in the future. No previous work had examined so comprehensively the philosophical and methodological foundations of comparative law. This is quite simply a book with which anyone embarking on comparative legal studies will have to engage.

This book features original essays by leading academics and emerging researchers written in honour of a legal comparatist who, over the course of four decades, has played a major role in comparative law's development: Pier Giuseppe Monateri. Rather than being just a celebrative work without analytical appeal, this book makes a significant contribution to the comparative legal literature by exploring key comparative law themes and recent developments in the field. Reflecting Monateri's vast expertise, innovative thinking, and truly global network, the volume is divided it into five thematic areas of both scholarly and practical significance: Comparative Law and Its Methods; Comparative Private Law; Law and Literature; The Politics and Ontology of Law; Comparative Law & Economics. Discussing novel case-studies as well as exploring Monateri's importance to the comparative enterprise through various trajectories of inquiry - for example, normative, doctrinal, empirical, critical - this book takes a fundamental and much-needed step towards the establishment of comparative law as a fully-fledged academic discipline and professional practice. Addressing the current status and future direction of comparative law, this book will appeal to legal comparativists, as well as students and scholars with broader interests in the nature of legal cultures.

This book was occasioned by the 30-year anniversary of the appearance of Professor John H. Jackson's remarkable book, World Trade and the Law of GATT, which pioneered the new academic discipline of international trade law. Professor Jackson's approach has been unique in its emphasis on a multidisciplinary approach, which places the subject in its proper context--by examining international trade law not only in relation to economic considerations but by broadening it to include wider societal concerns such as environmental, national security, human rights, and labour standards issues. Accordingly this book, in Professor Jackson's honour, reflects his role as a forerunner of the law of globalization, addressing in particular the links between trade law and public international law, and the connections between trade and other societal concerns. The book is divided into five sections, dealing with: constitutional issues; substantive issues for the WTO; dispute settlement in the context of the WTO; new subjects relating to the WTO system including trade and labour; trade and competition, trade and investment, bribery and corruption, and domestic issues for WTO member countries. After a long and distinguished career at the Law School of the University of Michigan, Professor Jackson joined the faculty of Georgetown University in 1998, as University Professor.

Comparative Law And Legal Traditions written by George Mousourakis and has been published by Springer Nature this book supported file pdf, txt, epub, kindle and other format this book has been release on 2019-11-01 with Law categories.

The primary aim of this book is to provide clear and reliable information on a number of central topics in comparative law. At a time when global society is increasingly mobile and legal life is internationalized, the role of comparative law is gaining importance. While the growing interest in this field may well be attributed to the dramatic increase in international legal transactions, this empirical parameter is only part of the explanation. The other part, and (at least) equally important, has to do with the expectation of gaining a deeper understanding of law as a social phenomenon and a fresh insight into the current state and future direction of one’s own legal system. In response to the internationalization of legal practice and theory, law schools around the world have expanded their comparative law programs. Within the legal subjects that form the core of the curriculum there is a greater interest in comparative legal analysis, as well as greater attention to how global developments and international actors and institutions affect domestic law. Transnational legal education based on comparative reasoning is intended to help shape a new generation of lawyers, public servants and other professionals who recognize and respect cultural diversity in an interconnected world. The central topics discussed in this book include: the nature and scope of comparative legal inquiries; the relationship of comparative law to other fields of legal study; the aims and uses of comparative law; the origins and historical development of comparative law; and the evolution and defining features of some of the world’s predominant legal traditions. It also deals with selected theoretical aspects, such as the problem of comparability of legal events; the classification of legal systems into families of law; and the topics of legal transplants, harmonization and convergence of laws. Chiefly intended for students, the book also discusses a number of fundamental issues concerning the development of comparative law, and devotes certain sections to reviewing the salient features of the relevant literature on definitional, terminological, methodological and historical issues.

Daarnaast is vergelijkende rechtsgeschiedenis sterk in opmars.
