Au Cameroun, la colonisation occidentale a eu pour conséquence logique un dessaisissement global des collectivités coutumières. Avec l’accession à l’indépendance, la situation ne va guère changer, puisque l’emprise de l’idéologie sur les catégories juridiques a ruiné toute perspective crédible des études coutumières dans les sociétés traditionnelles. Ce qui a favorisé l’embrigadement des études juridiques dans la perspective euro centrique, avec en prime la tentative péremptoire dont le droit ne s’est jamais dépêtré. Plus de six décennies après les indépendances, c’est faire œuvre utile que de rappeler à la conscience collective l’urgence qu’il y a de sortir des modèles juridiques imposés. Ceci, dans le but de redéfinir un nouveau contrat social pour les sociétés dites de tradition et consacrer ainsi la diversité des lieux de vie. C’est un plaidoyer pour la décolonisation du droit, la réarticulation du modèle délibératif d’essence communautaire. C’est aussi la consécration du processus d’endogénéisation de l’État en Afrique noire, ce qui passe par la réforme du paradigme dominant.
