In diesem Buch werden Patente auf gentechnisch veranderte Tiere und die dafur relevanten Verfahren diskutiert. Die Patentierung von Tieren widerspricht nicht grundsatzlich den geltenden Patentgesetzen. Ein Patentierungsausschluss von Erfindungen an Tieren ist aber in Art. 53 a) EPU fur solche Erfindungen festgelegt, die gegen die offentliche Ordnung oder gegen die guten Sitten verstossen. Was genau unter diesen Begriffen zu verstehen ist, wird aus der Vorschrift selbst heraus nicht deutlich. Das Buch leistet einen Beitrag zur Konkretisierung dieser Generalklausel, indem sie im Hinblick auf Patente auf Tiere ausgelegt und mit konkret anwendbaren Regeln ausgefullt wird. Dafur werden aus dem Gemisch von geschriebenen und ungeschriebenen Regeln in der Gesellschaft diejenigen grundlegenden Prinzipien identifiziert, die fur die Patentierung von Lebewesen relevant und hinreichend bedeutend sind, um Teil der offentlichen Ordnung und guten Sitten zu sein. Beispielhaft erfolgt die Untersuchung fur Deutschland, Frankreich und Grossbritannien. Die rechtsvergleichende Bildung europaisch einheitlicher Begriffe ist gerade im Hinblick auf die Einfuhrung des europaischen Einheitspatents von essentieller Bedeutung. Die Ergebnisse der Untersuchung werden in einem konkreten Vorschlag fur eine Erganzung des Art. 53 a) EPU zusammengefasst.
