Die Friedenspflicht zahlt zum selbstverstandlichen Inventar des deutschen kollektiven Arbeitsrechts. Sie dient dem Schutz zwingend geltender Tarifvertragsinhalte vor Anderungs- oder Abschaffungsbestrebungen, die durch einseitige Druckausubung im Kollektiv durchgesetzt werden sollen. Das Schutzinstrument ist nach uberkommener Auffassung der obligatorische Teil des Tarifvertrags. Dieser soll die Parteien zur Unterlassung des Einsatzes spezifischer Arbeitskampfmittel und gewohnlicher privatrechtlicher Individualrechte mit dem Ziel der kollektiven Abanderung oder Abschaffung der Tarifvertragsinhalte verpflichten. Die Relativitat dieses Schutzinstruments begrenzt jedoch seine Leistungsfahigkeit. Zur Vermeidung daraus folgender konstruktiver Bruche setzt Kai Thomas Brauneisen beim Wirkobjekt der Friedenspflicht an, den kollektiven Druckausubungsmitteln. Deren Binnengrenzen erlauben ihm die Herleitung friedenspflichtartiger Verhaltenspflichten ohne Ruckgriff auf eine im obligatorischen Teil des Tarifvertrags verortete besondere Aussenschranke.
