Following the terrorist attacks of September 11, 2001, the Central Intelligence Agency embarked on a highly classified program of secret detention and extraordinary rendition of terrorist suspects. The program was designed to place detainee interrogations beyond the reach of law. Suspected terrorists were seized and secretly flown across national borders to be interrogated by foreign governments that used torture, or by the CIA itself in clandestine 'black sites' using torture techniques. This report is the most comprehensive account yet assembled of the human rights abuses associated with secret detention and extraordinary rendition operations. It details for the first time the number of known victims, and lists the foreign governments that participated in these operations. It shows that responsibility for the abuses lies not only with the United States but with dozens of foreign governments that were complicit. More than 10 years after the 2001 attacks, this report makes it unequivocally clear that the time has come for the United States and its partners to definitively repudiate these illegal practices and secure accountability for the associated human rights abuses.

State Violence and the Execution of Law stages a provocative analysis of how the biopolitical divide between human and animal has played a fundamental role in enabling state violence, including torture, secret imprisonment and killing-at-a-distance via drones. Analyzing the complex ways in which the United States government deploys law in order to consolidate and further imperial relations of power, Pugliese tracks the networks that enable the diffusion and normalization of the state’s monopoly of violence both in the US and in an international context. He demonstrates how networks of state violence are embedded within key legal institutions, military apparatuses, civilian sites, corporations, carceral architectures, and advanced technologies. The author argues that the exercise of state violence, as unleashed by the war on terror, has enmeshed the subjects of the Global South within institutional and discursive structures that position them as non-human animals that can be tortured, killed and disappeared with impunity. Drawing on poststructuralist, critical race and whiteness, and critical legal theories, the book is transdisciplinary in its approach and value. It will be invaluable to university students and scholars in Critical Legal and Socio-Legal Studies, Cultural Studies, Race and Ethnicity Studies, International Politics, and Postcolonial Studies.

Fear has long served elites. They rely on fear to keep and expand their privileges and control the masses. In the current crisis of the capitalist world system, elites in the United States, along with other central countries, promote fear of crime and terrorism. They shaped these fears so that people looked to authorities for security, which permitted extension of apparatuses of coercion like police and military forces. In the face of growing oppression, rebellion against elite hegemony remains possible. This book offers an analysis of the crisis and strategies for rebellion. State Crime in the Global Age brings together original writings from leading scholars in the field to explore the many ways that the use and abuse of state power results in grave social harms that outweigh, by far, the consequences of ordinary street crime. The topics covered include the crimes of empire, illegal war, the bombing of civilians, state sanctioned torture, state sacrifice of human lives, and judicial wrongdoing. The book breaks new ground through its examination of the ways globalization has intensified potentials for state crime, as well as bringing novel theoretical understandings of the state to the study of state crime, and exploring strategies for confronting state crime. This book, while containing much that is of interest to scholars of state crime, is designed to be accessible to students and others who are concerned with the ways individuals, social groups, and whole nations are victimized by the misuse of state power.

The Politics Of Human Rights written by Tony Evans and has been published by Pluto Press this book supported file pdf, txt, epub, kindle and other format this book has been release on 2005-05-20 with Political Science categories.

In the past, violations of human rights were commonly portrayed as atrocities perpetrated by tyrannical dictatorships. Today, the images of torture at Abu Ghraib gaol, and the treatment of detainees at Guantanamo Bay, put the lie to this assumption. State violations of human rights have a global reach. This new edition of Tony Evan's introduction to the politics of human rights examines the impact globalization is having on human rights worldwide. He argues that the state’s role in protecting and promoting rights has been severely weakened under globalization – and that the emerging global order may be a cause of many human rights violations. As the value of the market grows, the value of individual human rights decreases. Tony Evans departs from traditional interpretations of human rights by focusing on the political economy of human rights, rather than on the philosophical or legal aspects. He analyses how issues related to globalization, such as the environment, population movement patterns and free trade impact on individual human rights. Rejecting liberal assumptions about globalization, Evans argues that human rights continue to be determined by hierarchies of knowledge and power.

Before 9/11, films addressing torture outside of the horror/slasher genre depicted the practice in a variety of forms. In most cases, torture was cast as the act of a desperate and depraved individual, and the viewer was more likely to identify with the victim rather than the torturer. Since the terrorist attacks of September 11, 2001, scenes of brutality and torture in mainstream comedies, dramatic narratives, and action films appear for little other reason than to titillate and delight. In these films, torture is devoid of any redeeming qualities, represented as an exercise in brutal senselessness carried out by authoritarian regimes and institutions. This volume follows the shift in the representation of torture over the past decade, specifically in documentary, action, and political films. It traces and compares the development of this trend in films from the United States, Europe, China, Latin America, South Africa, and the Middle East. Featuring essays by sociologists, psychologists, historians, journalists, and specialists in film and cultural studies, the collection approaches the representation of torture in film and television from multiple angles and disciplines, connecting its aesthetics and practices to the dynamic of state terror and political domination.

State Violence And The Execution Of Law written by Joseph Pugliese and has been published by this book supported file pdf, txt, epub, kindle and other format this book has been release on 2014-07-28 with Biological warfare categories.

State Violence and the Execution of Law examines how law plays a fundamental role in enabling state violence and, specifically, specifically, torture, secret imprisonment, and killing-at-a-distance. Analysing the complex ways in which the U.S. government deploys law in order to consolidate and further colonial and imperial relations of power, Joseph Pugliese tracks the networks that enable the diffusion and normalisation of the state's monopoly of legitimate violence both in the U.S. and transnationally. He demonstrates how these networks of state violence are embedded within key legal institutions (US Department of Justice), military apparatuses (U.S. Defense Advanced Research Projects Agency), civic sites (McCarran airport, Las Vegas), corporations (Boeing), carceral architectures (CIA Salt Pit, Kabul, and Guantánamo), and advanced technologies (unmanned aerial combat vehicles). Law's violence, it is maintained, is always preoccupied with the body: its torture, extortion or extermination. The exercise of state violence, it is argued, must be considered in situated locations that evidence the enmeshment of the body within geopolitical configurations of bio and necropower. For it is in these locations that law plays a foundational role in enabling and legitimising regimes of racialised violence. Drawing on poststructuralist, feminist, queer, critical legal, whiteness and anti-colonial theories, State Violence and Execution of Law brings into focus the contractual imbrication of the state with arms corporations and the contemporary military-industrial complex.

This major new study examines the developing practice of universal jurisdiction, as well as the broader phenomenon of "globalizing" justice, and its ramifications. With a detailed overview of the contemporary practice of universal jurisdiction, it discerns three trends at work: pure universal jurisdiction, universal jurisdiction "plus", and non-use. It also argues that these disparities in practice should raise serious concerns as to the legitimacy and perceived legitimacy of such globalized justice. It then turns to a further consideration, that of globalized justice, precisely because it takes place far from the locus of the crime, and is therefore "externalized" and may fail to achieve many of its putative goals. In addition, this is a key assessment of civil accountability, through the use of the Alien Tort Claims Act in the United States. It details how the use of civil penalties may offer new avenues for redress, particularly with relation to group accountability, whether that of armed groups or of corporations. However, it balances this approach to accountability with recognition of certain flaws within externalized criminal accountability. This study also focuses on mixed tribunals, or other methods of internationalized justice as viable alternatives, which may avoid some of the problems with external justice, but are themselves far from perfect. Mixed or hybrid tribunals in East Timor and Sierra Leone represent different models of hybrid justice and provide the reader with excellent examples of these new forms of justice in action. This book will be of great interest to all students and scholars of human rights international law and political science.
