Jean-Claude BARDOUT raconte l'histoire étonnante de cette loi 1901. Celle d'un long combat pour la liberté, qui prend naissance à l'aube de l'humanité : les premières civilisations sont à l'origine des premières formes d'association. Et depuis, cet esprit associatif a vaillamment traversé les époques, en rencontrant tour à tour adhésion ou opposition, approbation ou pénalisation. Jusqu'à ce 1er juillet 1901 qui voit l'aboutissement de l'œuvre d'un militant associatif et républicain, Pierre Waldeck-Rousseau. Mais bien des questions restent en suspens : la loi 1901 n'a-t-elle été votée que pour brider, sous couvert de liberté, les congrégations religieuses ? En abolissant la législation de la Révolution française à l'encontre des associations, n'ouvre-t-elle pas la voie au retour du corporatisme ? Ou est-ce le triomphe d'une nouvelle conception de l'association, où l'individualisme révolutionnaire et la solidarité seraient réconciliés ? Mais l'histoire des associations ne s'arrête pas en 1901 : cette liberté d'association dut se défendre de nombreux affronts, avant d'être élevée au rang de liberté constitutionnelle en 1971, puis restaurée à l'égard des étrangers en 1981, et enfin garantie par la Cour européenne de Strasbourg en 1999. Une histoire étonnante, pleine de rebondissements, riche en leçons et en réflexions à lire pour mieux comprendre les principes qui régissent aujourd'hui tous les organismes à but non lucratif.

For more than a century, urban North Africans have sought to protect and revive Andalusi music, a prestigious Arabic-language performance tradition said to originate in the “lost paradise” of medieval Islamic Spain. Yet despite the Andalusi repertoire’s enshrinement as the national classical music of postcolonial North Africa, its devotees continue to describe it as being in danger of disappearance. In The Lost Paradise, Jonathan Glasser explores the close connection between the paradox of patrimony and the questions of embodiment, genealogy, secrecy, and social class that have long been central to Andalusi musical practice. Through a historical and ethnographic account of the Andalusi music of Algiers, Tlemcen, and their Algerian and Moroccan borderlands since the end of the nineteenth century, Glasser shows how anxiety about Andalusi music’s disappearance has emerged from within the practice itself and come to be central to its ethos. The result is a sophisticated examination of musical survival and transformation that is also a meditation on temporality, labor, colonialism and nationalism, and the relationship of the living to the dead.
