La promulgazione, in Germania, della «legge per la protezione dai trattamenti di conversione» («Gesetz zum Schutz vor Konversionsbehandlungen» – KonvBG) fornisce occasione per l’avvio di una riflessione sistematica sulla legittimità di tali trattamenti, nonché, più in generale, sulla configurazione di un’identità sessuale integralmente affidata all’autodeterminazione del titolare. Gli scritti raccolti nel volume rappresentano l’esito di una ricerca interdisciplinare, che prende le mosse dalle conclusioni, alle quali è pervenuta la scienza medica, secondo cui qualunque tentativo di «conversione» dell’orientamento sessuale, specie di un minore, è inutile, se non dannoso. La disciplina positiva attualmente vigente in Italia, tuttavia, riesce soltanto in parte ad offrire una protezione da tali trattamenti: l’analisi del dettato costituzionale, della normativa penale e dei pertinenti istituti del diritto civile – quali la decadenza dalla responsabilità genitoriale o l’illecito endofamiliare – permette di delineare una tutela ancora in larga parte inadeguata, perché per lo più diretta ad intervenire dopo la realizzazione del trattamento, per rimuovere le conseguenze dannose da esso prodotte. La scelta compiuta in Germania si muove invece in una direzione opposta: perché, con l’imposizione di specifici divieti, modulati in modo differente in funzione dell’età del possibile destinatario del trattamento, mira a impedire la realizzazione del fatto. La valutazione delle condizioni e dei limiti con i quali la soluzione tedesca può essere riproposta in Italia impone, dunque, un’ampia riflessione sistematica, che si interroga in particolare sui profili di volontarietà, insiti nella scelta di ricorrere ai trattamenti di conversione, e sulla stessa rilevanza giuridica assunta, anche rispetto all’identità sessuale, dalle aspirazioni e dai desideri del singolo.
