No corporation is enthusiastic about paying tax, yet Islamic banks in Indonesia voluntarily pay corporate zakat. Why? The book analyzes corporate zakat norms and practices in Indonesia by investigating how Muslim jurists have interpreted sharīʿa of zakat and how these have been imposed through the legislative and regulatory framework. It also presents original case studies based on sociolegal field research on the reception of the new obligations in the Islamic banks that choose to pay – and choose not to pay – what is effectively a new tax. The book argues that the dynamics of sharīʿa interpretation, imposition, and compliance in Indonesia are too complex to be defined using the binaries of the religious versus the secular, public versus private, or tradition versus modernity. The corporate zakat context has revitalized the existing governance strategy in Islamic legal tradition and created a shared Islamic law vision between Islam and the state. Consequently, this fusion generates a mixed legal and religious consciousness toward corporate zakat. Addressing broader discussions on Islamic law and modernity, the book will be of interest to academics working on Asian and Comparative Law, sociolegal studies, anthropology of Indonesia, business studies of the Islamic world, Islamic/sharīʿa economics, Islamic law and politics, Islamic legal studies, Muslim society and Islam in Southeast Asia.

Under the rule of the current economic order, social injustice is ever-increasing. Issues such as poverty, inhumane working conditions, inadequate wages, social insecurity and an unhealthy labor market continue to persist. Many states are also unable to produce policies capable of resolving these problems. The characteristics of the capitalist system currently render it unable to provide social justice. In fact, on the contrary, the system reinforces these injustices and prevents economic and social welfare from reaching the masses. Many Muslim scholars have analyzed and, indeed, criticized this system for years. This book argues that an alternative and more equitable theoretical and practical economical order can been developed within the framework of Islamic principles. On the other hand, the experiences of societies under the rule of Muslim governments do not always seem to hold great promise for an alternative understanding of social justice. In addition, the behaviors of Muslim individuals within their economic lives are mostly shaped by the necessities of daily economic conditions rather than by the tenets of Islam that stand with social justice. Until 1990s, studies of Islamic economics made connections between finance and the notion of social justice, but work conducted more recently has neglected this issue. It is therefore evident that the topic of social justice needs to be revisited in a more in-depth manner. Filling an important gap in existing literature, the book uniquely connects social justice and Islamic finance and economics on this topic. A UN report recently found that the Asia Pacific is the world’s most disaster-prone region. Indeed, considering that the region accounts for more than half of the total number of disasters in the world, building capacity and resilience to mitigate the devastating impact of disasters is a pressing task for local actors. This book takes a regional, multidisciplinary and multi-actor approach to improve understandings of how various actors respond to natural and human-induced disasters in the Asia-Pacific region. It examines the ideas and activities of four different categories of agents: civil society; military and state institutions; local cultural knowledge and the media; and economic initiatives, and these themes are approached from various academic disciplines, ranging from anthropology and cultural studies to economics, human geography and political science. The contributors draw their findings from a variety of countries in the region, including China, Fiji, India, Indonesia, Japan, Myanmar and Samoa, and importantly, focus on the interconnection between vulnerability and resilience. In turn, the book highlights how the nature and magnitude of disasters are influenced by social conditions, and aims to contribute to policies that prioritize development opportunities to enhance resilience. Further, it explores the complicated and multifaceted role of agency in building resilience, and presents a comparative framework for analysis and key findings from the Asia-Pacific region.
