This book addresses the legal issues raised by the interaction between human rights and development in contemporary international law. In particular, it charts the parameters of international law that states have to take into account in order to protect human rights in the process of development. In doing so, it departs from traditional analyses, where human rights are mainly considered as a political dimension of development. Rather, the book suggests focusing on human rights as a system of international norms establishing minimum standards of protection of individuals and minimum standards applicable in all circumstances on what is essential for a dignified existence. The various dimensions covered in the book include: the discourse on human rights and development interrelationship, particularly opinio juris and the practice of states on the question; the notion of international assistance and cooperation in human rights law, under legal regimes such as international humanitarian law, and emerging rules in the area of protection of persons in the event of disasters; the extraterritorial scope of economic, social and cultural rights treaties; and legal principles on the respect for human rights in externally designed and planned development activities. Analysis of these topics sheds light on the question of whether international law as it stands today addresses most of the issues concerning the protection of human rights in the development process.

Institutions matter for the advancement of human rights in global health. The SSF Guidelines are based on internationally accepted human rights standards and are to be interpreted and implemented in accordance with those standards. Their objectives are to be met through the promotion of a human rights-based approach (HRBA). This approach seeks to ensure the participation of small-scale fishing communities in non-discriminatory, transparent and accountable decision-making processes by putting particular emphasis on the needs of vulnerable and marginalized groups and developing countries. While the HRBA has been recognized by FAO as a principle that informs the design, implementation, monitoring and evaluation of programmes and projects,1 there is still limited experience in its practical application in the context of small-scale fisheries (SSF). It is therefore important to explore how the approach could support the implementation and monitoring of the SSF Guidelines. Accordingly, the workshop on “Exploring the human rights-based approach in the context of the implementation and monitoring of the SSF Guidelines” explored what the human rights-based approach means within the context of small-scale fisheries in general and the thematic areas covered by the SSF Guidelines in particular. It discussed what the HRBA entails in terms of the conduct of the various state and non-state actors to whom the SSF Guidelines are addressed as well as the needs of the different stakeholders in the various policy areas, with a view to developing guidance materials for the application of the HRBA in the implementation and monitoring of the SSF Guidelines.

In demonstrating the impact of neoliberalism or market-based reforms on the developing world, the authors show that education without human rights is vulnerable to negative forces of globalization and internationalization. The message of the book is quite pessimistic about possibilities to widen the economic space or increase freedom, unless development cooperation is made possible by “Helping People Help Themselves” as suggested by David Ellerman. The authors note that in the past, the issue of emerging states as an appendage to the world economy was a fundamental question related to colonialism, but now has become a question of imperialism which needs to be examined when considering the current patterns of development.
