La Constitución se entiende en la actualidad como el orden jurídico fundamental del Estado y de la sociedad. La Constitución es la resultante de un proceso de confluencia entre las diferentes fuerzas políticas del Estado, que se «constituyen», que forman un orden «constitutivo», alcanzando un consenso acerca de las cuestiones básicas que afectan a la convivencia social, forma de Estado, sistema político, división del poder y protección de los derechos fundamentales. Este acuerdo, textualizado, se protege mediante mecanismos e instituciones que garantizan su supremacía. Y así, la Constitución queda establecida en la sociedad como un orden creado para la coexistencia en comunidad, de diferentes opciones políticas que consiguieron encontrar normas de convivencia en tolerancia mutua. Siendo la Constitución la norma fundamental del Estado, el centro del ordenamiento jurídico interesa analizar cómo ha de configurarse la actividad interpretativa del derecho, en un sistema en el que todas las normas han de ser conformes a esa norma fundamental. La razón de ser de esa supremacía constitucional, la legitimidad constitucional, en definitiva, es la referencia obligada de toda investigación que pretenda dar cuenta de la interpretación del derecho en la actualidad. Este estudio pretende afrontar el análisis de las principales doctrinas en esta materia, tanto en España como en derecho comparado.

"En este libro se abordan algunos tópicos esenciales de la interpretación jurídica en general y de la interpretación constitucional en particular, desde el plano de la filosofía jurídica. El principal punto de partida de la temática es la indeterminación de las disposiciones normativas, lo cual conlleva al problema de la interpretación jurídica (tensión entre razón y voluntad en el plano interpretativo) que encuentra un soporte en una concepción del Derecho.
