La interpretación de la Constitución es, sin duda, el tema central del Derecho Constitucional contemporáneo. La determinación de los derechos fundamentales encargada a los jueces en las actuales democracias constitucionales genera permanentes tensiones sobre el objeto y los límites de la interpretación constitucional. Laurence H. Tribe y Michael C. Dorf asumen en este libro que la actividad interpretativa se enfrenta con "desacuerdos sustanciales" que condicionan de manera significativa los resultados a los que se arriba. Uno de los propósitos que se plantean los autores es "desmitificar el proceso de interpretación de la Constitución", presentándolo como una actividad comprometida con valores, pero al mismo tiempo, orientada por una serie de pautas y principios que restringen las posibilidades del subjetivismo moral irracional. Apoyados en la enorme tradición del constitucionalismo jurisprudencial norteamericano, los autores trazan pautas y rebaten los argumentos del conservadurismo expresado en el originalismo norteamericano que pretende limitar la actividad interpretativa a la búsqueda de la "intención original". Laurence H. Tribe Graduado de la Harvard Law School y profesor de Derecho Constitucional en la misma universidad, ha defendido más de treinta casos ante la Corte Suprema de los Estados Unidos, incluyendo el caso Bush vs. Gore, como abogado de este último, en el que Bush ganó las elecciones presidenciales. Michael C. Dorf Graduado de la Harvard Law School, trabajó como asistente del Juez Anthony M. Kennedy. Ha defendido casos ante la Corte Suprema de los Estados Unidos y actualmente se desempeña como profesor en la Cornell Law School.

Este libro de la profesora Claudia Nikken, que es el décimo número de la colección Monografías coeditada por el Centro para la Integración y el Derecho Público (CIDEP) y la Editorial Jurídica Venezolana, presenta una primera aproximación a los temas de las fuentes del Derecho Constitucional y de la interpretación de la Constitución, considerados por la autora como indisociables, ya que la determinación de las fuentes del Derecho Constitucional es, sobre todo, obra de la interpretación de la Constitución. A tal efecto, la investigación está dividida en dos capítulos: En el primero de ellos la autora se refiere a la definición material y formal de la Constitución, las características que habitualmente se le atribuyen y las nociones de supremacía constitucional, supraconstitucionalidad y el bloque de la constitucionalidad. Por su parte, en el segundo capítulo, Nikken aborda el tema de la interpretación al distinguir entre intérpretes oficiales y no oficiales, sus mecanismos y criterios, la autenticidad de la interpretación y el llamado "poder constituyente secundario," para luego referirse a los problemas y dificultades que plantea el tema, así como las responsabilidades que derivan de su ejercicio.
