The subject of this book is the social and political meaning of constitutional texts to the detriment of their legal concretization. Focusing on the discrepancy between the hypertrophically symbolic function of constitutions and their insufficient legal concretization, it offers a critical counterpoint to constitutional theory that treats constitutional texts as a panacea to solving political, legal, and social problems. In contrast to the premises of Niklas Luhmann's systems theory regarding law and constitution in world's society, symbolic constitutionalization is approached here in both a comprehensive and far-reaching perspective. Chapter 1 sets out the debate about symbolic legislation. Chapter 2 explains the notion of symbolic constitutionalization as a problem embracing the whole legal system. Chapter 3 approaches the issue in terms of allopoiesis of law, characterizing it primarily as a problem in peripheral modernity and referring to the Brazilian experience. The final chapter discusses the tendency to a symbolic constitutionalization of world society in the scope of a paradoxical peripheralization of the centre.

Insurgent citizenships have arisen in cities around the world. This book examines the insurgence of democratic citizenship in the urban peripheries of São Paulo, Brazil, its entanglement with entrenched systems of inequality, and its contradiction in violence. James Holston argues that for two centuries Brazilians have practiced a type of citizenship all too common among nation-states--one that is universally inclusive in national membership and massively inegalitarian in distributing rights and in its legalization of social differences. But since the 1970s, he shows, residents of Brazil's urban peripheries have formulated a new citizenship that is destabilizing the old. Their mobilizations have developed not primarily through struggles of labor but through those of the city--particularly illegal residence, house building, and land conflict. Yet precisely as Brazilians democratized urban space and achieved political democracy, violence, injustice, and impunity increased dramatically. Based on comparative, ethnographic, and historical research, Insurgent Citizenship reveals why the insurgent and the entrenched remain dangerously conjoined as new kinds of citizens expand democracy even as new forms of violence and exclusion erode it. Rather than view this paradox as evidence of democratic failure and urban chaos, Insurgent Citizenship argues that contradictory realizations of citizenship characterize all democracies--emerging and established. Focusing on processes of city- and citizen-making now prevalent globally, it develops new approaches for understanding the contemporary course of democratic citizenship in societies of vastly different cultures and histories.

Durante toda a evolução social e histórica de nosso país nos deparamos com o problema da regularização fundiária; atualmente e em especial, a urbana. Tal questão por muitos anos foi ignorada pelo legislador pátrio, que preferiu voltar sua atenção para outras demandas. Todavia, com a transformação dos valores sociais, esse comportamento não se faz mais possível, passando então a ser editadas leis que visam atualizar a realidade jurídica conforme a realidade social existente. No tocante ao direito de moradia, significante inovação legislativa ocorreu em 22 de dezembro de 2016, com a edição da Medida Provisória n. 759, convertida na Lei n. 13.465, de 11 de julho de 2017. De grande extensão temática, a nova lei dispôs sobre diversos temas e alterou numerosas leis, dentre elas, a Lei n. 10.406, de 10 de janeiro de 2002, inserindo uma nova modalidade de direito real no inciso XIII do artigo 1.225 do Código Civil Brasileiro, chamada de "direito real de laje", e, consequentemente, novo título ? o Título XI ? no Livro III, Do Direito das Coisas, para tratar, pontualmente, nos novos artigos 1.510-A a 1.510-E, a respeito da nova figura jurídica. Este trabalho volta-se à análise desse novo instituto de direito real, importante no cenário jurídico-social brasileiro, notadamente na questão habitacional, a fim de estudá-lo de maneira detalhada, buscando sua conformação junto à sistemática do Código Civil de 2002 e ao ordenamento jurídico como um todo.
