Introduction à l'article de doctrine de ce numéro : Le Fürstenrecht et les mariages au sein de la maison grand-ducale de Luxembourg Le téléscopage de deux événements dynastiques majeurs — d’une part la publication récente de deux nouveaux « décrets grand-ducaux », d’autre part, le mariage prochain du grand-duc héritier — appelle à une investigation d’un champ de l’ordre juridique luxembourgeois jusque-là oublié et occulté : le Fürstenrecht de la maison grand-ducale. Quel est ce droit, ce « droit princier », qui ne figure dans aucun manuel, alors que l’un de ses objets n’est ni plus ni moins la succession au trône? Quelles sont les règles de ce droit princier à propos des mariages princiers? Qu’en est-il, exactement, de ce mystérieux pouvoir d’autorisation des mariages princiers par le Grand-Duc, pouvoir dont l’existence semble davantage connue des magazines spécialisées dans la vie des Royals que des manuels de droit, de droit constitutionnel et de droit civil? Sur quelle norme étatique se fonde ce pouvoir, à supposer d’ailleurs qu’il s’agisse d’un pouvoir valide (ce qui est fort discutable)? Quel est l’intérêt qui puisse justifier un refus de consentement : l’intérêt de la famille grand-ducale ou l’intérêt général? Quelle en est la procédure : l’acte du Grand-Duc est-il, à l’instar de la pratique suivie à l’étranger, soumis à l’exigence du contreseing ministériel? L’acte est-il publié? Quels sont les effets d’un refus sur le statut du prince ou de la princesse concernés eu égard à la succession au trône et au fidéicommis de la maison grand ducale? Existe–t–il une voie de recours? Eu égard à toutes ces questions, une analyse scientifique approfondie fait apparaître que la publication des deux décrets n’a point dissipé tout le mystère entourant ce Fürstenrecht. Pour s’en rendre compte, il suffit de se poser en juriste, en citoyen-juriste (et non en lecteur de magazines), une question assez simple : le prince Louis, depuis son mariage avec Tessy Antony, a-t-il encore un droit de succession au trône du Grand-Duché de Luxembourg? Dans une monarchie moderne, dans un État de droit, la réponse devrait être claire et certaine. Or elle ne l’est point. (...)

Propos irrévérencieux sur l'utilisation de l'argument du sens clair en jurisprudence luxembourgeoise par Me Pierre HURT, avocat au barreau de Luxembourg Souvent les magistrats invoquent dans leurs jugements, de même que les avocats dans leurs plaidoiries, l’argument du sens clair de la loi, comme la loi jurisprudence administrative, ne résiste pas à un examen critique. Pour preuve, l’analyse de la pratique des jugements montre que dans bien des cas où l’argument est effectivement utilisé, il s’avère, après réflexion, que le texte de loi ne fut nullement clair. L’argument se révèle alors comme un moyen commode de faire taire les débats et de couper court à l’argumentation de l’un des plaideurs. Mais, c’est surtout l’examen théorique de l’argument du sens clair qui en dévoile l’inanité. C’est que le constat de la clarté d’un texte n’interdit nullement l’interprétation. Au contraire, il la présuppose déjà. Ainsi, la théorie du sens clair des lois participe de ce qu’on a pu appeler le «refoulement» de l’interprétation. Mais alors dans quelles conditions peut-on affirmer qu’un texte de loi est clair?

La Cour européenne des droits de l’homme et le droit au respect des biens : une synthèse, par D. Spielmann et V. Bruck L'article 1er du Protocole additionnel à la Convention consacre « le droit au respect des biens » en prévoyant des limitations tant à la privation de propriété qu’à la réglementation de l’usage des biens, qui ne sont donc nullement exclues. Par son oeuvre interprétative, la Cour européenne des droits de l’homme a pu donner un relief particulier à la notion de « bien ». Cette jurisprudence trace également les limites du droit de propriété à travers la réglementation de l’usage des biens. Ces limites sont toutefois circonscrites par la notion d’« atteinte à la substance », qui permet de soumettre au contrôle de la Cour toute ingérence rendant incertaine la situation juridique d’un bien, sans toutefois pouvoir s’analyser en une privation de propriété ou en une réglementation de l’usage des biens. Dans ce cadre, les mêmes conditions de légalité et de nécessité doivent être remplies et un « juste équilibre » doit être maintenu entre l’intérêt général et les droits fondamentaux de l’individu.
