De 1954 à 1962, au nom de la lutte contre la " subversion " du FLN, au nom du rattachement de l'Algérie à la France qui interdisait d'y appliquer le droit de la guerre et de considérer les nationalistes comme des combattants, la justice et son personnel prirent une part active à la guerre d'Algérie : instruction des affaires, condamnations par milliers infligées par les tribunaux correctionnels et militaires, rappel de magistrats sous les drapeaux, etc. Les seules condamnations à mort atteignirent les 1 500, dont près de 200 furent exécutées. Dans ce livre passionnant et très documenté, Sylvie Thénault montre que cette insertion de la justice dans un vaste système de répression la priva de fait de son droit de regard sur les arrestations, les gardes à vue, les détentions et les interrogatoires pratiqués par l'armée. S'appuyant sur des archives jusque-là inaccessibles de l'Armée de terre - instructions, directives, fiches de renseignements, etc. - et du ministère de la justice, notamment la correspondance entre les procureurs généraux d'Algérie et la Chancellerie parisienne, elle met au jour une justice amputée et réformée par les législations d'exception. Une " drôle de justice ", à l'image de la " drôle de guerre ", cette guerre qui n'en était pas vraiment une. Il est temps, aujourd'hui, que ce passé proche entre dans l'Histoire. Pour les magistrats qui l'ont vécue, appelés à jouer un rôle inédit, confrontés au partage de compétence avec la justice militaire et à la torture, la période reste douloureuse. C'est pour l'aborder sereinement, sans juger ni céder aux injonctions d'un " devoir de mémoire " culpabilisant, que l'auteur a écrit ce livre.

Rebel Courts presents an argument that it is possible for non-state armed groups in situations of armed conflict to legally establish and operate a system of courts to administer justice. Neither the concept of the rule of law nor the general principle of state sovereignty stands in the way of framing an understanding of the rule of law adapted to the reality of rebel governance in the area of justice. Legal standards applicable to non-state armed groups in situations of international or non-international armed conflict, including international humanitarian law, international human rights law, and international criminal law, recognise their authority to regularly constitute or establish non-state courts. The lawful operation of such courts is of course subject to requirements of due process, corresponding to an array of guarantees that must be respected in all cases. Rebel courts that are regularly constituted and operate in a manner consistent with due process guarantees demand a certain degree of recognition by international institutions, by states not involved in the conflict, to some extent by the territorial state, and even by other non-state armed groups. These normative claims are grounded in a series of detailed case studies of the administration of justice by non-state armed groups in a diverse range of conflict situations, including the FARC (Colombia), Islamic State (Syria and Iraq), Taliban (Afghanistan), Tamil Tigers (Sri Lanka), PKK (Turkey), PYD (Syria), and KRG (Iraq).

The outsourcing of military and security services is the object of intense legal debate.
