In februari 2008 lanceerde de Raad van de Europese Unie de European Union Rule of Law Mission in Kosovo (EULEX) met als doel de Kosovaarse autoriteiten bij te staan bij de verdere ontwikkeling van een Kosovaarse rechtstaat. Op basis van veldonderzoek in Kosovo en interviews met onder andere leden van EULEX en de Kosovaarse politie wordt in dit boek onderzocht hoe Europa in samenwerking met de lokale overheden met vallen en opstaan een verantwoordelijk, onafhankelijk en goed functionerend politie- en justitieapparaat heeft getracht te creëren. Any effort to gather evidence may prove pointless without ensuring its admissibility. Nevertheless, the EU, while developing instruments for smooth gathering of evidence in criminal matters, is not taking much effort to enhance its admissibility. Due to the lack of common rules in this matter, gathering and use of evidence in the EU cross-border context is still governed by the domestic law of the member states concerned. This may lead to situations where, given the differences between legal systems across the EU, evidence collected in one member state will not be admissible in other member states. Due to the fact that the Lisbon Treaty opened the possibility to adopt minimum rules concerning, among other things, the mutual admissibility of evidence, this research investigates the concept of minimum standards designed to enhance mutual admissibility of evidence in the EU. Through a study of two investigative measures, telephone tapping and house search, the author examines whether coming to various common minimum standards is feasible and whether compliance with these standards would finally shape the as yet nonexistent concept of the free movement and mutual recognition of evidence in criminal matters in the EU. Essential reading for both national and EU policy makers, scholars and practitioners involved in cross-border gathering of evidence in the EU.

In toenemende mate blijkt echter dat de overlevering kan leiden tot schendingen van fundamentele rechten en de opsluiting in veilige, humane noch resocialiseringsgerichte omstandigheden. In dit onderzoek wordt dieper ingegaan op detentiecondities in EU-lidstaten. Één aspect van de detentie wordt er specifiek uitgelicht – het tuchtrecht – gezien de impact die het tuchtrecht kan hebben op de leefomstandigheden in de gevangenis (denk bv. aan de opsluiting in een strafcel, het verlengen van de detentieduur of het beperken van het familiebezoek). Er wordt in de diepte bestudeerd of het tuchtregime verloopt conform de internationale detentiestandaarden. In het boek wordt elke internationale detentiestandaard m.b.t. het tuchtrecht tegen het licht gehouden en wordt onderzocht of in de wetgeving en in de praktijk deze standaarden worden nageleefd. Nadien wordt bekeken welke juridische gevolgen de niet-naleving van deze internationale standaarden heeft op de samenwerking tussen lidstaten.

National literary histories based on internally homogeneous native traditions have significantly contributed to the construction of national identities, especially in multicultural East-Central Europe, the region between the German and Russian hegemonic cultural powers stretching from the Baltic states to the Balkans. National Oil Companies (NOCs) directly or indirectly control the majority of oil and gas reserves. As such, they are of great consequence to their country's economy, to importing countries' energy security, and to the stability of oil and gas markets. The paper analyzes the available evidence on the objectives, governance and performance of 20 NOCs from both net importing and net exporting countries, and draws conclusions about the design of policies and measures that are more likely to lead to social value creation. NOCs differ from private companies on a number of very important variables, including the level of competition in the market in which they operate, their business profile along the sector value chain, and their degree of commercial orientation and internationalization. Most share some core characteristics: they are usually tied to the 'national purpose' and serve political and economic goals other than maximizing the firm's profits. This paper introduces a conceptual model to analyze value creation by NOCs that takes into consideration their complex objective function. Our analysis aims to answer the following questions: Are certain corporate governance arrangements more suited than others to promote value creation? Is good geology a pre-condition for NOC value creation? Are there benefits from exposing the NOC to competition from private oil companies? Does the development of forward and backward linkages hamper NOC value creation?

In The Heroic Earth, David T. Murphy argues that geopolitical ideas were most dynamic and significant in Germany not during the Nazi era (1933-45) but in the democratic culture of the Weimar republic (1919-33). By helping to condition the German population to geopolitical ideas, which emphasized revision of the Versailles settlement and enlarging Germany's living space, geopolitics helped contribute to Nazi imperialism. From the defeat of Germany in 1918 until the rise of National Socialism i9n 1933, theories of geographical determinism enjoyed a broad currency in many fields of German public life. The ancient notion that environmental factors--climate, topography, resource distribution--shape society in significant ways was now applied in a radically determinist fashion to help Germans understand why they had lost the war and what they had to do to regain their place among the Great Powers. Under the rubric of Geopolitik, politicians, teachers, writers and others argued that they key to Germany's past, and the hope for its future, lay in understanding geography's determining impact upon races, cultures, states, and warfare. Theories of geographical determinism shaped German thinking about politics, race, science, education, aesthetics, and many other subjects on the eve of the Nazi era. Challenging traditional historiography, Murphy argues that geopolitics faded in importance after Adolf Hitler came to power.
