Der Autor beschäftigt sich mit materiellrechtlichen und internationalprivatrechtlichen Fragestellungen im Zusammenhang mit dem französischen Rechtsinstitut der action directe. Besondere Bedeutung kommt im Hinblick auf ihre praktische Relevanz im internationalen Rechtsverkehr vor allem dem direkten Zahlungsanspruch des Subunternehmers gegen den Auftraggeber sowie dem haftungsrechtlichen Durchgriffsanspruch des Endabnehmers gegenüber dem Erstverkäufer im Rahmen von internationalen Vertragsketten zu. Ausgehend vom materiellrechtlichen Funktionsmechanismus der action directe, der in der Einbeziehung des Gläubigers in den Wirkungsbereich des Haupt- bzw. Erstvertrages der Vertragskette besteht, wird die Frage nach der internationalen Gerichtszuständigkeit auf der Grundlage des EuGVÜ sowie nach dem auf die action directe anwendbaren Recht aus der Sicht des deutschen und französischen Kollisionsrecht untersucht. Entscheidend ist dabei, daß entgegen einer jahrhundertelangen französischen Rechtstradition Schadensersatzansprüche des in seinem Integritätsinteresse verletzten Endabnehmers gegen den Hersteller eines fehlerhaften Produktes dem Anwendungsbereich der vertraglichen Durchgriffshaftung, die nunmehr ausschließlich bei Äquivalenzverletzungen zum Zuge kommt, entzogen worden sind und auf kollisionsrechtlicher Ebene dem französischen Statut der internationalen Produkthaftung im Sinne des Haager Übereinkommens vom 2. Oktober 1973 unterstellt werden.Bei der Arbeit handelt es sich um die erste (in deutscher Sprache) verfaßte Dissertation in gemeinsamer Betreuung mit einer ausländischen Fakultät (thèse en co-tutelle). Der Autor erhielt von der Universität Straßburg den Grad eines docteur en droit verliehen.
