Cet ouvrage est consacré à l’étude de l’aveu dans les traditions pénales occidentales accusatoire et inquisitoire depuis le pré-droit grec jusqu’à nos jours. Avant d’être une règle de preuve et de devenir une pièce autonome de procédure, l’aveu a d’abord été un outil exploratoire de l’individu en philosophie avant que la religion s’en empare comme un dispositif de contrôle des âmes. L’aveu juridique a donc été précédé d’un aveu moral dont il ne s’est jamais vraiment départi. Bien qu’ils partagent des racines communes, les systèmes accusatoire et inquisitoire ont établi des règles différentes à son égard. Dans la procédure accusatoire, issue de la tradition de common law, l’aveu poursuit certes un objectif de vérité à l’instar de la procédure inquisitoire. Mais, contrairement à cette dernière, il a dû répondre très tôt à un impératif de fiabilité, conduisant à la création de règles de preuve et de procédure qui ont ainsi permis de limiter, du moins en apparence, sa fonction politique. Cette différence de traitement de l’aveu dans les deux systèmes ne peut se comprendre que dans le cadre d’un récit historique et les droits qui le concernent ne peuvent vraiment s’apprécier qu’avec l’apport de connaissances qui lui sont extérieures. L’auteur mobilise à cet effet de nombreuses sources multidisciplinaires, juridiques d’abord, mais aussi relevant des sciences humaines et sociales, comme la philosophie, la théologie, la psychologie et l’histoire. Cette étude n’est pas l’œuvre d’un historien, mais celle d’un juriste qui a voulu explorer les origines, certes historiques, mais aussi épistémologiques, d’une règle de preuve – et non la moindre – pour comprendre son essence, ce qu’elle a été, ce qu’elle est et ce qu’elle pourrait devenir.

The reports were written for the XIVth Congress of the International Academy of Comparative Law which was held in 1994 in Athens, Greece. As narcotics trafficking exploded in the 1980s, it was realized that money laundering had become a threat to the entire integrity of the financial system. The international trend to regard money laundering as a serious threat to the stability of democracy and the rule of law found expression in the adoption of the 1988 United Nations Drugs Convention. Gradually, the international community diverged from its traditional, narrow approach whereby only the laundering of drug proceeds was considered a threat. In order to combat money laundering efficiently, it soon became clear that criminal law was not sufficient and that it was necessary for banks and other financial institutions to co-operate with law enforcement agencies. The banking community is now obliged to report suspicious transactions, which they often regard as going beyond their role as bankers. The issue of bank secrecy has played an important role in the discussion between law enforcement agencies and the banking community. Both the Council of Europe Convention on Laundering Search, Seizure and Confiscation of the Proceeds from Crime and the UN Drugs Convention require that bank secrecy should not be an obstacle to international co-operation. At the national level the seizure of bank records should not be hindered by bank secrecy.
