La Constitution fédérale laisse beaucoup de liberté aux cantons suisses pour réglementer leurs régimes d’aide sociale. De grandes différences subsistent en la matière. Les personnes vivant en Suisse, selon leur lieu de domicile, n’ont pas toutes accès aux mêmes prestations et ne bénéficient donc pas de la même protection contre la pauvreté. Or, ce phénomène a un impact conséquent sur la jouissance des droits humains, qui font pourtant l’objet de conventions internationales ratifiées par la Suisse nécessitant une mise en œuvre sur l’ensemble de son territoire. Dans ce contexte, cet ouvrage cherche à savoir si ces garanties internationales exigent une harmonisation des droits cantonaux de l’aide sociale. À l’aune de la pandémie mondiale récente de COVID-19, qui ne s’arrête pas aux frontières cantonales et qui touche durement les populations précaires de Suisse, cette question revêt une grande actualité. L’auteur y répond en démontrant, selon plusieurs critères juridiques, différentes obligations concrètes d’harmonisation. Cette démarche permet d’avancer vers une réponse globale à un problème qui touche et touchera à l’avenir de nombreux individus de la population suisse, quel que soit leur domicile : la pauvreté.

This study explains in an accessible manner the key elements of the relationship between the Swiss Confederation and the European Union. The author begins by summarizing the main steps in this special and evolving relationship which has long oscillated between membership and marginalization. He also guides us expertly through the thickets of referendums (no fewer than fourteen from 1972 to the time of writing!) in which Swiss citizens have been given the opportunity to pass judgment on the European question.
