L'internationalisation des constitutions correspond à l'influence de l'évolution du droit international et des relations internationales sur l'organisation des pouvoirs publics et sur les droits fondamentaux. L'internationalisation des pouvoirs publics signifie que la séparation des pouvoirs et la répartition des compétences entre ces pouvoirs sont modifiées par le jeu des relations internationales : le pouvoir exécutif est le grand bénéficiaire tandis que le pouvoir législatif perd beaucoup de son importance et qu'enfin le pouvoir juridictionnel voit sa fonction d'application du droit modifiée. L'internationalisation des constitutions en ce qui concerne les droits fondamentaux conduit à l'élaboration d'un statut juridique international de l'individu dont le contenu se stabilise en matière de droits politiques mais est encore en voie de formation pour les droits civils et les droits économiques et sociaux. Des résistances étatiques à cette évolution se manifestent, car il s'agit de la détermination des rapports entre l'individu et l'état et le modèle de société choisi par un peuple s'en trouve affecté. Malgré les progrès constatés, des difficultés subsistent aussi bien au sujet de la garantie interne du statut juridique international de l'individu par le législateur et le juge national, qu'en ce qui concerne les mécanismes de protection au niveau international, dont l'évolution est très inégale selon les continents. Si les constitutions peuvent évoluer pour s'adapter à l'internationalisation de l'organisation des pouvoirs publics, une telle adaptation est beaucoup plus complexe dans le domaine des droits fondamentaux et implique des sacrifices pour la démocratie constitutionnelle.

Le droit international public a une influence active sur l'ordre constitutionnel des États post-conflits. This book examines the largely neglected but crucial role of transnational actors in democratic constitution-making. The writing or rewriting of constitutions is usually a key moment in democratic transitions. But how exactly does this take place? Most contemporary comparative constitutional literature draws on the concept of constituent power – the power of the people – to address this moment. But what this overlooks, this book argues, is the important role of external, transnational actors who tend to play a crucial role in the process. Drawing on sociolegal methodologies but informed by new legal realism, this book develops a new theoretical framework for examining the involvement of such actors in constitution-making. Empirically grounded, the book uncovers a more comprehensive picture of how constitution-making unfolds on the ground. By combining a method – comparative studies – with an ongoing process – the internationalization of law, that is, its extension beyond national borders – this Chair looks to the future, as uncertain as it may be. Of course current events tragically highlight the absence of a real legal world order. The collective security system of the Charter of the United Nations has shown its weaknesses and law has been unable to disarm force. Conversely, however, force cannot prevent this unprecedented extension of law, to the extent that no State can lastingly override it. In spite of appearances, it is no longer possible today to ignore the superposition of regional, national and global standards, nor the over-abundance of both national and international institutions and judges, with expanded jurisdiction. The new realities are causing law to evolve into complex and highly unstable interactive systems that are perhaps more symptomatic of profound change than of the defeat of law: we are faced with a change in the very conception of the legal order.
