Fidèle à ses traditions, l'AFDA a consacré son colloque annuel 2013, organisé à l'Université de Strasbourg, à l'un des thèmes les plus fondamentaux du droit administratif, le service public. Mais l'habitude est désormais prise d'observer les thèmes fondateurs du droit administratif sous un angle novateur et résolument moderne. Réputé construit comme discipline juridique grâce à l'apport de célèbres doctrines, le service public ne s'est jamais départi de sa faculté de véhiculer de fortes valeurs sociales. Bien que le droit public français ne se conçoive pas sans le service public, il existe des Etats qui se sont passés de l'idée même de service public et d'autres qui ont développé une autre approche de la notion. Malgré ses capacités d'adaptation et de résistances, le service public n'en subit pas moins de puissantes mises à l'épreuve, qu'elles proviennent, très diversement d'ailleurs, de l'analyse économique du droit, du droit de l'Union ou encore de la réforme de l'Etat. Généralement centré sur l'usager, le service public pose naturellement aujourd'hui la question de son accès à certaines catégories de la population. Les modes de gestion connaissent une diversification sans précédent et sont désormais intimement liées au droit de la commande publique. En ces temps de disette budgétaire, le financement du service public est au coeur de l'actualité, tant du point de vue du renouvellement des méthodes de financement que de leur confrontation au droit de la concurrence et de la mise en concurrence. Enfin, le statut des biens affectés au service public fait l'objet d'incontournables développements récents. Non seulement le service public est en soi une notion appelant l'application d'un régime juridique particulier, mais il a également développé de fortes relations d'attraction/répulsion avec d'autres notions du droit administratif, ce qui explique son caractère central et fondateur. A-t-on dépassé l'antagonisme police administrative / service public ? La fonction publique est-elle toujours dédiée exclusivement aux activités de service public ? Le service public est-il l'objet de tous les contrats administratifs ? Entre tradition et modernité, au coeur de plusieurs disciplines sociales, résistant aux lois du marché tout en s'y adaptant, le service public reste et restera un éternel sujet d'études pour les juristes du XXIe siècle.

The volume presents the results of a research project (named “Legafight”) funded by the Luxembourg Fond National de la Recherche in order to verify if and how digital tracing applications could be implemented in the Grand-Duchy in order to counter and abate the Covid-19 pandemic. This inevitably brought to a deep comparative overview of the various existing various models, starting from that of the European Union and those put into practice by Belgium, France, Germany and Italy, with attention also to some Anglo-Saxon approaches (the UK and Australia). Not surprisingly the main issue which had to be tackled was that of the protection of the personal data collected through the tracing applications, their use by public health authorities and the trust laid in tracing procedures by citizens. Over the last 18 months tracing apps have registered a rise, a fall, and a sudden rebirth as mediums devoted not so much to collect data, but rather to distribute real time information which should allow informed decisions and be used as repositories of health certifications.
