The responses of governments and international institutions to terrorism raise some of the most controversial issues of the twenty-first century. In particular, attempts to balance the desire to achieve security with the safeguarding of human rights and other aspects of the rule of law have proved to be highly contentious. En Financiar la Constitución se reúnen cinco ensayos donde se plantea un problema jurídico –pero, también, político-económico– de enorme actualidad: cómo pensar la relación que debe haber entre los derechos humanos y las restricciones financieras de los Estados. Ante una situación de conflicto, ¿a qué se le debe dar más peso: a los derechos reconocidos en las constituciones y en los tratados internacionales de derechos humanos o a las capacidades financieras de los Estados? Para ello se propone, como horizonte teórico, una Teoría General de la Constitución Financiera, a la que se considera la mejor forma de comprender hoy en día la doctrina financiera y tributaria. Sobre tal base, una adecuada presentación del problema requiere considerar, de forma simultánea, cuatro procesos históricos: a) la constitucionalización del derecho financiero y tributario, b) el desarrollo del derecho internacional de los derechos humanos, c) la creciente importancia de las reglas fiscales y d) la experiencia judicial comparada, en la que pueden verse argumentaciones que tienen en cuenta los anteriores procesos. Estos, a su vez, tienen un carácter global, que excede los marcos de los derechos nacionales, de ahí la necesidad de tener en cuenta el derecho comparado, así como la incidencia del derecho internacional.
