Se trata de un esfuerzo colectivo de investigadores, jueces constitucionales e interamericanos y otros operadores jurídicos, dirigido a identificar los fundamentos del derecho constitucional común latinoamericano, así como a fomentar debates académicos y diálogos interjurisdiccionales que favorezcan su consolidación. El libro que hoy ponemos en manos de las y los lectores intenta, precisamente, entre otros propósitos, sentar las bases para la comparación del papel institucional de la jurisdicción constitucional en distintos ordenamientos jurídicos de la región. El control de convencionalidad es un instituto articulado por la Corte Interamericana de Derechos Humanos desde 2006, a partir del fallo Almonacid Arellano y otros vs. el Estado de Chile, que supone para los jueces, y las demás autoridades públicas de los distintos Estados que tienen parte en la Convención Americana sobre Derechos Humanos, el deber de analizar la compatibilidad entre el Derecho interno y el corpus iuris interamericano al momento de decidir el Derecho aplicable. A una década de vigencia del control de convencionalidad corresponde su análisis reflexivo, crítico y prospectivo, tal como se formula en este trabajo. La presente obra colectiva recopila una serie de trabajos (15), de los más prestigiosos especialistas chilenos y extranjeros sobre el control de convencionalidad. Por ejemplo, los votos razonados de las sentencias de la Corte Interamericana que introdujeron la noción corresponden al Juez Sergio García, y él es autor de uno de los trabajos contenidos en esta obra. Asimismo, el actual vicepresidente de la Corte Interamericana y autor de libros y artículos sobre la materia, el juez Eduardo Ferrer Mac Gregor, también colabora en el presente libro. Por su parte, la actual consejera de la Comisión Interamericana de Derechos Humanos, Flavia Piovesan, trata la temática a propósito del caso brasilero. Todo con el respaldo de la coordinación conjunta de las profesoras Miriam Henríquez y Mariela Morales; así como el prólogo del Dr. Armin von Bogdandy, Director del Max Planck Institute for Comparative Public Law and International Law, Alemania, principal centro de investigación europeo en Derecho Público. Constitutional reform has been one of the most significant aspects of democratization in late twentieth century Latin America. In The Friendly Liquidation of the Past—one of the first texts to examine this issue comprehensively —Van Cott focuses on the efforts of Bolivia and Colombia to incorporate ethnic rights into their fragile democracies. In the1990s, political leaders and social movements in Bolivia and Colombia expressed dissatisfaction with the quality of democracy--its exclusionary nature, the distance and illegitimacy of the state, and the empty promise of citizenship. The highly symbolic act of constitution making elevated a public struggle for rights to the level of a discussion on the meaning of democracy and the nature of the state. Based on interviews with more than 100 participants in the reforms, Van Cott demonstrates how issues promoted by social movements—recognizing ethnic diversity, expanding political participation and improving representation, and creating spheres of cultural and territorial autonomy—were placed on the constitutional reform agenda and transformed through strategic interaction with political power-brokers into the nation’s highest law. The analysis follows each reform through five years of implementation to assess the early results of what Van Cott suggests is an emerging regional model of multicultural constitutionalism. The Friendly Liquidation of the Past fills an important gap in the study of ethnic politics and constitutional reform in the Andes, linking the literature on institutions and political reform to work in political theory on participatory democracy and multiculturalism.
