L'objet affiché du Statut de Rome de la Cour pénale internationale est de « mettre un terme à l'impunité » des auteurs de crimes de droit international. Plus de deux décennies après la conclusion de cet instrument, l'heure est à un premier audit ou retour d'expérience. Les États parties ont en ce sens initié une revue de fonctionnement du système en vigueur en raison des difficultés rencontrées par la Cour pour mener à bien sa mission. Des recommandations et un programme de travail ont été adoptés. Mais l'ensemble néglige les fractures du système judiciaire. Ici, l'étude de la pratique de l'ensemble des droits de la défense, de la phase préliminaire à l'après-procès, permet d'apporter une évaluation complémentaire au rapport des experts. Trois catégories de défaillances, d'ordre statutaires, organiques ou structurelles, peuvent être identifiées. Elles révèlent un certain nombre de manquements aux garanties initialement posées. La conduite de la procédure au stade de la « préparation » de la défense apparaît particulièrement problématique en ayant une incidence majeure sur la « présentation » de la défense. La pratique des droits de la défense devant la CPI demeure à ce stade précaire.

Pour autant une partie des professionnels de la justice pénale internationale a attiré l'attention de la doctrine sur les difficultés de mise en oeuvre concrète de ces garanties devant les juridictions pénales internationales. Des critiques, soutenant la thèse d'une ineffectivité des droits de la défense devant les juridictions pénales internationales, ont alors pu naître. L'étude se propose de vérifier le bien-fondé de ces critiques. Au moyen d'un examen détaillé de la jurisprudence des juridictions pénales internationales, elle détermine, dans un premier temps, que la plupart des garanties des droits de la défense sont protégées en procédure internationale pénale. L'une d'entre elles fait toutefois défaut : il s'agit de l'accès aux pièces à décharges se trouvant en la possession exclusive des procureurs des juridictions pénales internationales. C'est pourquoi, dans une seconde partie, l'étude propose d'identifier et d'analyser le comportement des procureurs faisant obstacle à l'accès de ces pièces par la défense. Ce comportement fait l'objet d'une construction notionnelle inédite, sous l'appellation de la réticence dans la communication des pièces.
