Le droit européen tient désormais une place de plus en plus importante comme source du droit des médias, directement par lui-même et/ou par l’intermédiaire des droits nationaux et le contrôle et l’influence qu’il exerce sur eux. Compte tenu du rôle (politique, économique, social, culturel, de divertissement...) joué par la communication et les médias, le « droit européen des médias » appelle l’attention et suscite l’intérêt. Comme les droits nationaux, le droit européen des médias trouve une part de sa justification et de son unité dans son objet ou son champ d’application que sont les « médias » et toutes les formes de communication « publique ». Au regard de l’inévitable et sans doute souhaitable dimension transnationale ou transfrontière qui est aujourd’hui celle des médias, un droit national apparaît insuffisant, inefficace et inadapté. Dans les espaces européens (de l’Union européenne et du Conseil de l’Europe) au moins, cela conduit à chercher à élaborer un droit commun européen. Supérieur à celui de chacun des États, un tel droit devrait permettre la libre circulation des médias et de leurs contenus (information d’actualité, connaissances et documentation en tous genres, divertissement...), tout en assurant (autant que possible, mais cela n’est pas toujours vérifié !), de manière harmonisée, le respect de droits apparemment opposés ou concurrents et qui méritent, eux aussi, une égale attention et protection. Par « droit européen des médias », est considéré celui qui (sous forme de dispositions textuelles et de décisions rendues par les juridictions : Cour européenne des droits de l’homme et Cour de justice) émane des deux structures ou institutions que sont le Conseil de l’Europe et l’actuelle Union européenne. L’harmonisation européenne des droits des médias nationaux doit ou devrait contribuer à donner plus de force et de réalité au droit, à renforcer les libertés autant que la responsabilité. Les unes ne vont pas sans l’autre ! Avant tout, il convenait de fournir ici, de manière inévitablement sélective, la documentation (textes et jurisprudence) relative au « droit européen des médias ». Dispersée, elle était, jusquelà, difficilement accessible et exploitable. Seules les sources brutes permettent d’avoir une pleine connaissance et compréhension du droit en cause et de porter sur lui, après analyse et réflexion ainsi rendues possibles, une juste appréciation.
