In offering a critical analysis of the writings of Cornelius van Bynkershoek (1673-1743) - the eminent Dutch jurist known traditionally as a `positivist', in the history of international law - this work goes beyond an analysis of the `classics' per se to clarify some basic questions concerning the history of international law, such as the relationship between legal doctrine and state practice and the reconsideration of methodological differences among historical figures like Grotius, Pufendorf, and Vattel. It also covers some fundamental problems of international law generally, such as the meaning of positivism and positive law and the function of reason. The work comprises three main parts: - the construction of Van Bynkershoek's general theory of the law of nations, - an overview and analysis of the contemporary practice relevant to his theories on the laws of neutral commerce, and - the 'genealogy' of Van Bynkershoek's works, namely his relation to Grotius and to his later generations of publicists. Excerpt from Les Assurances sur la Vie en Droit International Privé Selon cette théorie, il faudrait donc résoudre d'abord le con flit de lois relatif au lieu du contrat et appliquer ensuite la loi du lieu ainsi déterminé. Il me semble pourtant que ce raison nement se ment dans un cercle vicieux. La recherche qu'il entraînerait à faire consisterait, en effet, à voir si la con vention tombe sous l'empire de telle législation plutôt que de telle autre; mais, quelle que soit la législation à laquelle on s'arrètera, c'est elle qui devra déterminer aussi le lieu et le moment de la formation du contrat. Toutes les législations contiennent des règles sur cette question; par suite, si l'on veut admettre que la stipulation est régie par la loi allemande, elle devra lui ètre également soumise à ce point de vue. Mais, dit-on, la détermination du lieu est une recherche préalable. Préalable assurément, quand ce lieu existe matériellement, parce qu'alors tout se réduit à s'enquérir d'un fait; mais du moment qu'il s'agit d'une recherche d'ordre purement juridi que, il faudrait y procéder en se basant sur la loi à laquelle la convention elle-mème est soumise, surtout si l'on réfléchit à l'importance de cette détermination relativement à la compé tence. Pouvons-nous admettre que la fixation du moment où commence l'engagement des parties soit un élément extrinsè que, susceptible de recevoir une solution distincte? Cela résul terait forcément d'un pareil système, car il fait du lieu et du temps deux éléments qui ne rentrent nullement dans la sub stance de l'affaire. Si l'on est d'avis, au contraire, que l'un et l'autre doivent dépendre de la loi du contrat, on comprend qu'il faille commencer par découvrir cette loi pour fixer ensuite ses éléments. Mais, en suivant la méthode que nous critiquons et en voulant d'abord rechercher le lieu du contrat, en com mence par donner pour base au raisonnement la loi d'un pays donné, alors que le but de ce raisonnement est précisément de découvrir à quelle loi le contrat doit obéir.
