Pourquoi deux pays voisins réforment au même moment leur contentieux administratif pour octroyer au juge de nouveaux pouvoirs à l'encontre de l'Administration? Cela traduit-il le passage d'un contentieux fondé sur le contrôle à une justice fondée sur la protection (E. Garcia de Enterria, M. Fromont)? L'exigence commune aux deux pays de garantir le droit au juge correspondant à un mouvement général en Europe. Cette similitude n'explique pas la convergence des mécanismes. La spécificité du régime de droit administratif commun aux deux pays apparaît comme un élément structurant déterminant des nouveaux pouvoirs. Le renouvellement des règles coïncide avec le renouvellement des conceptions de la justice administrative sous l'influence allemande. La conception commune dominante de la "subjectivation" repose sur un présupposé jusnaturaliste opposant les droits au droit étatique supposé oppresseur, or le droit objectif n'est pas opposé, mais noyé sous la diversité des droits individuels (Carbonnier).

This book contributes to the debate about the impact of European Community Law on the national constitutional orders and cultures of the respective Member States. The author examines the doctrine of sovereignty as a mechanism within which this impact may be best assessed and in particular how it underwrites the tension between European Union rights and the rights provided by the respective legal orders of the Member States. In particular the book focuses on political,social and civil rights, drawing from T.H. Marshall's typology. In endorsing an appropriate analytical framework, the book challenges both existing law and secondary literature in order to argue that the terminology, the concepts and the tools which are used to assess the impact of the EC law on the national constitutional orders are to be selected with great care. This is particularly apposite given the complexity of constitutional diversity, in terms of national constitutions and their reception of EC law. It is also important because of the variety of approaches involved in the constitutional adjustment of the acquis of the Union within the context of the increasing drive to constitutionalisation of the Union on the one hand and enlargement on the other.

In the centre of the whole educational cosmos stands the pupil, the student. He or she has rights, sanctioned by a national and international judicial apparatus. The freedoms of parents, teachers and education establishments are functional in the service of the rights of the "user of education", as is the government's assignment. They hold a joint responsibility with regard to the right of a young person to be educated, and a fortiori of the school-age young person. The context in which education takes place is nevertheless undergoing major change. In recent times, schools have been presenting themselves more as brittle social institutions, sensitive to internal and external conflicts. If every education establishment is a crossroads of legal relationships, this does not leave the pupil or student untouched. He or she can seek recourse to fundamental rights; but against these can be set certain obligations - and in the first place the obligation to take account of the rights of fellow pupils and students. Educational sociologists have for some time been interested in the rela tionship between the behaviour of pupils and the quality and effectiveness of the school. I Practitioners of law in general, and education law in particular, could not ignore the legal status of the education user. It immediately became apparent how interwoven education is with a diversity of disciplines within the legal domain, as well as with other scientific disciplines.
