Si dans les débuts de la conquête spatiale il était impératif de déterminer les droits et obligations des états dans ce nouveau domaine international, l'introduction progressive d’entités non gouvernementales, fait naître aujourd'hui le besoin similaire de poser des règles régissant leurs activités à vocation économique. Notre thèse est construite autour de trois axes de démonstration : I. Le droit de l'espace s'applique aux activités spatiales à vocation économique comme à toutes autres activités spatiales. Ce faisant il établit un régime assez neutre vis-a-vis de ces dernières. Le droit de l'espace tolère ces activités. II. Mais en marge de ce droit de l'espace général, se développe un encadrement juridique spécifique aux activités spatiales à vocation économique, qui se traduit par la gestion mixte des réseaux de télécommunications internationales, l’élaboration de règles particulières par l'Agence spatiale européenne (en faveur de la commercialisation et privatisation des activités spatiales), mais encore par un essor de législations nationales spécifiques et enfin par la multiplication de normes d'origine contractuelle. III. Cet éclatement des sources du droit de l'espace, ne doit pas occulter le fait que les états dans l'avenir continueront de jouer un rôle prédominant dans l'espace.

Les forces du marché ont investi le domaine des activités lequel, jusqu'à récemment, impliquait des acteurs essentiellement publics. En effet, l'industrie spatiale a pris conscience, le potentiel commercial de l'espace, et l'exploitation commerciale de l'espace constitue désormais du droit positif. Cette commercialisation croissante conduit à la naissance de nouveaux opérateurs dans l'espace, à caractère privé, que ce soient des entreprises privées, des entreprises étatiques privatisées, des organisations internationales en cours de privatisation, qui ne sont pas les destinataires naturels des instruments traditionnels du droit de l'espace. Les mutations techniques, réglementaires, industrielles et juridiques qui ont marqué le secteur spatial, seront étudiées ainsi que l'état de la privatisation et de la commercialisation dans les différents secteurs d'activités du domaine spatial (le lancement, moyen d'accéder à l'espace, les télécommunications par satellite, l'observation de la Terre, les systèmes de navigation par satellite, la Station spatiale internationale). Il s'agira ensuite, grâce à une approche transversale, de dégager les conséquences des phénomènes de commercialisation et de privatisation dans le secteur spatial, phénomènes qui prennent ici tout leur sens. Sur ce plan, les évolutions sont spectaculaires, profondes et extrêmement rapides. Elles affectent en particulier les modes de financement des activités spatiales, le secteur de l'assurance et le droit des contrats, objet de toutes les attentions, car révélateur de rapports de forces très changeants entre les acteurs du secteur spatial. Ces rapports de forces sont en pleine redéfinition, de sorte que la cartographie des risques pesant sur chaque participant à l'industrie spatiale s'en trouve redessinée, certes de manière discrète, loin des effets d'annonces, mais n profondeur.
