Le présent ouvrage analyse le projet de révision constitutionnelle d’Emmanuel Macron en le mettant en perspective avec les soixante ans de la Ve République. Il montre que ce projet ne vise pas à modifier l’équilibre des pouvoirs car il s’inscrit dans la lecture présidentialiste de nos institutions voulue par le général de Gaulle. Il détaille les trois objectifs du projet de loi : renforcer l’État de droit en rendant le parquet indépendant et en soumettant les ministres aux tribunaux de droit commun, démocratiser nos institutions par l’introduction d’une dose de proportionnelle dans l’élection des députés et les rendre plus efficaces avec la réduction du nombre de parlementaires et la limitation du cumul des mandats dans le temps. Cet ouvrage avance, au nom de Démocratie Vivante, trois propositions : porter à 25 % la part des députés élus à la proportionnelle mais en retenant le même scrutin que pour les municipales ; renforcer les missions du CESE ; constitutionnaliser la loi Larcher qui oblige le gouvernement à proposer une négociation aux partenaires avant le dépôt d’un projet de loi portant sur le droit du travail ou la formation professionnelle.

On constate, la dernière décennie, la multiplication des renvois à un instrument d'application de la révision constitutionnelle. Alors qu'il semble ne s'agir que d'une technique de rédaction, le foisonnement des renvois pour application est révélateur d'une tendance plus profonde, la politique d'affichage. En renvoyant systématiquement aux textes d'application à venir, parfois sur des points cruciaux, l'inflation des renvois accuse la démission, la « non-décision » du pouvoir de révision. Elle a pour conséquence de rejeter la révision constitutionnelle dans la vie politique au quotidien. En amont, la loi constitutionnelle détermine la marge de manœuvre laissée au texte d'application. En aval, la rédaction et l'application de ces textes se heurtent systématiquement aux instruments de parlementarisme rationalisé ainsi qu'à la loi d'airain de la majorité. En ouvrant un espace de manœuvre, le mécanisme de renvoi pour application offre aux pouvoirs constitués le levier de rééquilibrage qui leur manquent au niveau constitutionnel. En fin de compte, les résistances opposées à l'application de la révision ne sont pas seulement imputables à la faiblesse du mécanisme de renvoi, mais aussi à toute la signification des rapports institutionnels sous le parlementarisme rationalisé de la Ve République. La logique majoritaire se trouve imprégnée dans la mise en œuvre du renvoi pour application de la révision, ce mécanisme participe ainsi au déséquilibre institutionnel. Au terme de cette étude, le renvoi pour application apparaît comme un facteur contribuant à la rigidité de la Constitution de la Ve République, révélant l'impossibilité des institutions de s'auto-réformer.

Judge Shigeru Oda, having served since 1976 in three successive nine-year terms on the International Court of Justice, has helped to shape the Court's jurisprudence for over a quarter century.
