Cet ouvrage est le fruit de multiples rencontres réalisées durant les deux sessions du Campus international d'été sur le statut comparé des Peuples autochtones organisé à la Faculté de droit de l'Université de Rouen en 2010 et 2011. Manifestation unique en France, ce Campus, basé sur la philosophie de l'université populaire et donc ouvert à tous, a été conçu avant tout comme un lieu de dialogues. De différentes manières, la vie de ces peuples s'inscrit dans une histoire continuelle de luttes contre une menace récurrente d'ethnocide. Leur offrir un espace dédié à la parole et propice à un dialogue serein a contribué à une information que nous souhaitons partager, information qui est le fruit de rencontres riches d'enseignements réciproques, propices à la recherche de réponses adaptées aux situations de rencontre culturelle. La notion de "peuples autochtones" est aujourd'hui très souvent au coeur de l'actualité car elle est prise dans les soubresauts d'une conjoncture historique plus ouverte que jamais au multiculturalisme. Cet ouvrage a pour but d'étudier de façon critique différentes réalités autochtones de par le monde. Il existe en effet diverses façons d'être autochtone, de se revendiquer autochtone. Plusieurs problèmes cruciaux sont mis en lumière en recourant à des associations d'idées telles que l'interdépendance toujours plus forte entre les hommes, l'urgente nécessité d'articuler les valeurs occidentales avec les valeurs non occidentales, et l'impressionnante montée en puissance des intérêts privés. This book takes an interdisciplinary approach to the complicated power relations surrounding the recognition and implementation of Indigenous Peoples’ rights at multiple scales. The adoption of the United Nations Declaration on the Rights of Indigenous Peoples in 2007 was heralded as the beginning of a new era for Indigenous Peoples’ participation in global governance bodies, as well as for the realization of their rights – in particular, the right to self-determination. These rights are defined and agreed upon internationally, but must be enacted at regional, national, and local scales. Can the global movement to promote Indigenous Peoples’ rights change the experience of communities at the local level? Or are the concepts that it mobilizes, around rights and political tools, essentially a discourse circulating internationally, relatively disconnected from practical situations? Are the categories and processes associated with Indigenous Peoples simply an extension of colonial categories and processes, or do they challenge existing norms and structures? This collection draws together the works of anthropologists, political scientists, and legal scholars to address such questions. This publication aims to make the Venice Commission's work in the field of protection of minorities more available to the public. It includes, on the one hand, the Proposal for a European Convention on the protection of minorities, as a reply to the heartfelt need for protection of minorities at the European level. The proposal and its explanatory report appear in the first chapter of the publication. This publication includes, in addition, firstly the report on the protection of minorities at domestic law level which was drawn up within the framework of the Venice Commission and secondly the report concerning the special protection of which minorities can take advantage in States with a Federal or Regional structure. The report in question was established on the basis of replies provided by representatives of several European and non-European States to a questionnaire drawn up by the Commission; the questionnaire, together with the replies, appears in an Appendix to the report. Perusal of the replies given by representatives of different States to the same question allows for a rapid appraisal of the solutions adopted in national laws to identical problems of protection of minorities.
