Com o intuito de, efetivamente, desburocratizar o acesso à justiça, a Lei n. 9.099, publicada em 26 de setembro de 1.995, deu corpo aos Juizados Especiais Cíveis e Criminais, colocando fim à legislação que, até então, disciplinava o tema e que convencionou-se chamar de Juizados de Pequenas Causas (Lei n. 7.244, de 7 de novembro de 1.984), terminologia de duvidosa compreensão, diga-se de passagem, como se pudéssemos conceber, de fato, o que poderia ser, em termos práticos, uma “pequena” ou uma “grande causa”. Decorridos, pois, 25 (vinte e cinco) anos de sua vigência, é certo que não estamos diante de uma legislação completa, preenchedora de todas as lacunas existentes, mesmo porque todo trabalho humano necessita de permanente aperfeiçoamento/complemento, sem contar que sua elaboração reflete o momento histórico, político, econômico, social etc. daquele período em que fora edificada. (...) Aqui, temáticas caras a todos que se dedicam aos aspectos dogma e pragmáticos deste rito especialíssimo, tais como os negócios processuais, juízos de admissibilidade, tutelas provisórias, qualificada fundamentação das decisões judiciais, necessária distribuição dinâmica do ônus da prova, recursos, medidas executivas, conciliação e mediação, arbitragem e execução, dentre muitos outros, são enfrentados de modo crítico e profundo por profissionais atuantes no foro e na Academia e pertencentes a vários Estados da Federação, possibilitando múltiplos olhares sobre fenômenos diversos.”
