Sont-ce les nouvelles formes de terrorisme qui sont à l’épreuve du droit, ou plutôt le droit qui est à l’épreuve et éprouvé par les nouvelles formes de terrorisme ? Le temps du droit n’est pas celui du terrorisme a souligné le professeur Dhommeaux dans son rapport de synthèse. L’objet de cet ouvrage collectif tend à préciser si les réponses du droit international et les réponses du droit français dans toutes ses disciplines sont efficaces pour contrecarrer la menace terroriste dans ses nouvelles manifestations. Les deux journées d’études des 5 et 6 novembre 2015 organisées par les doctorants du Centre de Droit Éthique et Procédures (CDEP) ont été l’occasion de fournir des clés pour comprendre ce qui se passe aujourd’hui en France et dans le monde en partant de la conceptualisation et de la rhétorique du terrorisme jusqu’à l’indemnisation de ses victimes. Face à un phénomène mondial, la réponse doit être globale, et le droit à lui seul ne suffit pas en réalité à répondre à toutes les questions soulevées par les nouvelles formes de terrorisme. Aux côtés des questions juridiques, la lutte contre la menace terroriste suscite des points de vue religieux, philosophiques, sociologiques, linguistiques et culturels et politiques. Le succès de ces journées de réflexion s’explique par leur approche pluridisciplinaire et l’originalité des thèmes peu abordés sur le plan théorique et pratique. La transversalité des thèmes abordés, le désenclavement des disciplines et l’entrecroisement fécond de tous les débats de ces deux journées d’étude consacrées au « droit à l’épreuve des nouvelles formes de terrorisme » ont permis de favoriser la complémentarité des savoirs, l’esprit d’ouverture sur un phénomène devenu mondial et de prendre la pleine mesure de tous les aspects de ce phénomène à la fois ancien et nouveau.

Le droit français s'est doté de dispositions spécifiques en matière de lutte contre le terrorisme à partir de la loi n° 86-102 du 9 septembre 1986. Par la suite, le Code pénal de 1994 a intégré les infractions relatives au terrorisme aux articles 421-1 et suivants, dans le Livre IV consacré aux crimes et délits contre la nation, l'Etat et la paix publique. Depuis lors, les très nombreuses réformes qui caractérisent la matière n'ont eu de cesse de développer l'autonomie des incriminations et le recours à des procédures d'exception pour tenter de proposer une réponse adaptée à "la menace terroriste". Cette tendance s'est encore récemment renforcée après les derniers attentats commis sur le sol français, et particulièrement ceux de janvier et de novembre 2015. Plus qu'en tout autre domaine, la répression se trouve associée à une volonté de prévenir les infractions. Or, la prévention à l'état pur, celle qui consisterait à identifier et réprimer les auteurs avant le passage à l'acte, est difficilement compatible avec les principes directeurs du droit pénal et soulève un délicat problème d'équilibre de la législation tant le risque d'atteinte aux libertés individuelles est fort. La dernière réforme, issue de la loi n° 2016-731 du 3 juin 2016 renforçant la lutte contre le crime organisé, le terrorisme et leur financement et améliorant l'efficacité de la procédure pénale, illustre parfaitement ce dilemme. Cette loi, particulièrement dense, use de tous les leviers de la matière pénale. Elle prévoit de nouvelles incriminations, propose d'adapter les peines ainsi que la mise en oeuvre d'une politique pénitentiaire favorisant la "dé-radicalisation". Surtout, elle contient un important volet procédural qui confère aux enquêteurs de nouvelles prérogatives en autorisant le recours à certains procédés tels que l'IMSI catcher. Comme la récente loi sur le renseignement du 24 juillet 2015, la réforme du 3 juin 2016 suscite un véritable questionnement quant au respect des libertés et droits fondamentaux, notamment la vie privée. En filigrane, c'est également la pertinence d'une politique pénale sujette à de telles variations qui peut être discutée. La répétition des réformes, plutôt que la réactivité des pouvoirs publics, ne traduirait-elle pas finalement une certaine incapacité à saisir et à endiguer l'activité terroriste ? L'ouvrage aborde l'ensemble de ces aspects afin de discuter des principales dispositions de la loi du 3 juin 2016, dans un contexte d'état d'urgence prolongé, avec le souci de "croiser les regards" dans la perspective d'élargir la perception du terrorisme et de ses enjeux par une combinaison des approches : juridiques et criminologiques, universitaire et pratiques, répressives et préventives, de droit interne et de droit européen.

The scale and horror of recent terror attacks and the panic which ensued throughout the world has forced policy-makers and international lawyers to re-examine international legal tools available to enforce norms against terrorism. The magnitude of the attacks, the modalities of the operations, the profiles of the terrorists and the transnational structure of some terrorist organisations all cast doubt on the adequacy of the existing political and legal framework to fight terrorism. Due to this perception, governments have increased the intensity of measures to combat terrorist activities such as using military force against States sponsoring terrorism, freezing assets of terrorist organizations, and promulgating national security measures designed to protect the State against would be terrorists. This book comprehensively analyses the suitability of existing international legal tools to enforce rules prohibiting terrorism. More than ever before International Humanitarian Law needs to find new solutions to new types of conflicts. The current state of the fight against terrorism is without doubt one of the new problems facing international society and one of the concerns of International Humanitarian Law. This volume offers reflections on the international legal theory of terrorism, international responsibility, the obligation to prevent terrorist acts, terrorism in armed conflicts, the responses to terrorism by regional international organizations and the legal limits to the fight against terrorism. The contributors consist of academics (and politicians) from Morocco, Algeria, Egypt, Tunisia, Lebanon and Israel, as well as from Spain, Italy, France, the United Kingdom, Switzerland and a representative for the Organisation of American States.
