Jusqu’en 2010, le contrôle de constitutionnalité de la loi en France était exclusivement a priori et sur saisine d’autorités politiques. L’entrée en vigueur de la QPC, permettant au justiciable d’alléguer, au cours d’un procès ordinaire, la contrariété de la loi applicable à ses droits et libertés constitutionnels, a donc été saluée comme mettant fin à une exception française au sein du modèle européen de justice constitutionnelle. Pourtant, aucune mise en perspective de cette nouvelle procédure avec celles existant dans les pays proches n’avait été entreprise à ce jour. L’ouvrage y remédie à travers une comparaison systématique des questions de constitutionnalité en France, Espagne et Italie, élargie de façon plus ponctuelle à d’autres exemples (Allemagne et Belgique). Les atouts et faiblesses des différents mécanismes nationaux sont mis en lumière par l’analyse successive des procédés de filtrage de la question, du jugement de la Cour constitutionnelle et de ses suites ainsi que de l’insertion de la question dans l’environnement juridictionnel global. La comparaison invite en définitive à une réflexion plus générale sur l’évolution des systèmes de justice constitutionnelle à l’heure de la pluralité des juges des droits fondamentaux. L’ouvrage présente les résultats d’une recherche de deux ans, menée par une équipe de chercheurs originaires des trois pays principalement étudiés, et soutenue par la Mission droit et justice (Ministère français de la justice – CNRS). Il est enrichi du compte-rendu des débats et discussions intervenus lors du colloque final de cette recherche qui s’est tenu en 2013 à la Faculté de droit d’Aix-en-Provence.
