Conflicts of laws arising from injuries to rights of personality—such as defamation or invasion of privacy—have always been difficult, if only because they implicate conflicting societal values about the rights of freedom of speech and access to information, on the one hand, and protection of reputation and privacy, on the other hand. The ubiquity of the internet has dramatically increased the frequency and intensity of these conflicts. This book explores the ways in which various Western countries have addressed these conflicts, but also advances new, practical ideas about how these conflicts should be resolved. These ideas are part of an international model law unanimously adopted by a Resolution of the Institut de droit international, which addresses jurisdiction, choice of law, and recognition and enforcement of foreign judgments. The book provides extensive article-by-article commentary, which explains the philosophy and intended operation of the Resolution.

Dans un État où le pouvoir judiciaire est quasi inexistant pour se prononcer sur les questions relatives à la protection des libertés fondamentales et où le pouvoir exécutif se place au-dessus de tout, la République Démocratique du Congo est de loin un exemple en matière des droits humains. Et plus encore en période électorale, les coupures du réseau Internet et de services des messages courts, sont intempestives sans observance des normes, bien que, embryonnaires, qui réglementent les restrictions à apporter aux libertés fondamentales. Et pourtant, le droit d’accès à Internet intègre aujourd’hui, indirectement, la grande famille des droits fondamentaux, par un processus d’annexion au droit à la liberté d’expression et d’information. Toutefois, son universalité, qui pourrait bien garantir sa reconnaissance et sa protection juridictionnelles, fait défaut. Ce qui fait du droit d’accès à Internet une sorte de droit fondamental en gestation. Conséquemment, l’absence de législation publique internationale en la matière favorise le non-respect du droit d’accès à Internet par nombre des États dans le monde. Cette étude démontre que les limitations (restrictions) à l’accès à Internet en République Démocratique Congo lors de la période électorale de décembre sont souvent constitutives de violation aux termes de l’article 19 § 3 du Pacte international relatif aux droits civils et politiques, eu égard non seulement aux liens étroits qu’Internet entretient avec la liberté d’expression et d’information mais également à la protection aménagée pour les droits sus-indiqués dans une société démocratique aux fins de leur effectivité.

Tools to counter hate speech that undermines free electoral competition. “Everyone has the right to freedom of expression. This right shall include freedom to hold opinions and to receive and impart information and ideas without interference by public authority and regardless of frontiers.” (Article 10 of the European Convention on Human Rights) Freedom of expression is enshrined in the European Convention on Human Rights and protects citizens from interference with their right to freely express their opinions. This freedom is essential when it comes to the electoral process which, like any competition, has a strict framework of rules. Freedom of expression must not give rise to hate speech that would undermine the electoral process by polluting the campaign and political debate necessary for voters to make an informed choice. This toolkit is intended to explain the international standards applicable in this respect, provide tools and strategies that can be used by election management bodies to counter hate speech harmful to free electoral competition and describe the Georgian experience in this area.
