Lorsqu’on examine le régime de la presse en droit belge, tel que les bases en sont fixées depuis 1831 dans la Constitution, on est frappé de constater que les principales garanties et dispositions qui définissent et protègent la liberté de la presse sont en réalité des dispositions procédurales. Il ressort de l'analyse systématique de ces règles procédurales que la liberté d'expression constitue un droit fondamental d'un statut particulier. Sa protection est en effet assurée par un régime de garanties procédurales exorbitantes du droit commun, dont le champ d'application s'étend à l'ensemble des médias, indépendamment de la qualité de l'auteur de la diffusion de l'opinion ou de l'information exprimée. Il ne s'agit nullement d'un droit subjectif prééminent accordé à la presse ou aux journalistes mais bien d'un dispositif d'ordre public quasi-constitutionnel établi dans l'intérêt général et qui ne vise pas à protéger une profession en particulier mais bien une liberté en faveur de tous : un véritable droit à l'information. Après avoir dissipé la confusion traditionnellement entretenue entre le rôle de la presse et celui de la justice, l'auteur démontre pour quels motifs il convient d'écarter radicalement la tendance qui cherche à faire de la presse la débitrice des exigences du procès équitable. Ces exigences ne sont en effet invoquées à son égard que pour tenter de contourner le dispositif procédural protecteur et imposer un contrôle préalable du contenu de l'information. L'ensemble de l’ouvrage permet enfin de montrer que la prééminence de la protection de l'information et le régime procédural d'exception dont cette liberté bénéficie s'expliquent en raison du caractère spécifique du droit protégé qui, contrairement à une opinion généralement défendue, ne se place pas dans un lien d'égalité avec d'autres libertés ou droits fondamentaux, mais les précède pour constituer le socle fondateur et l'horizon de la démocratie.
