Updated as of May 29, 2018 The National Oceanic and Atmospheric Administration (NOAA) issues regulations revising the agency's requirements for the licensing, monitoring and compliance of operators of private Earth remote sensing space systems under Title II of the Land Remote Sensing Policy Act of 1992 (the Act). These regulations implement the provisions of the Act, as amended by the 1998 Commercial Space Act, and the 2003 U.S. Commercial Remote Sensing Policy. They are also derived from experience gained since August 2000 with respect to the licensing of commercial remote sensing space systems, and include improvements that take into account public comments received on the regulations. They are intended to facilitate the development of the U.S. commercial remote sensing industry and promote the collection and widespread availability of Earth remote sensing data, while preserving essential U.S. national security interests, foreign policy and international obligations. This book stems from the worrying scale and intensity of conflicts, humanitarian crises, and human rights violations around the world, which can be seen in a wide range of global hotspots including Venezuela, Yemen, Syria, Myanmar, Sudan, Eritrea, and numerous others. These developments are also relevant for Europe, given the large-scale migrations they can produce. In order to effectively respond to them, it has become imperative to analyse ways in which space data and technologies can be used to uphold human rights and monitor violations. Various international tribunals, such as the International Court of Justice (ICJ) and the International Criminal Court (ICC), are increasingly relying on satellite data and especially images when considering human rights violations cases. This use of space-related technologies represents a trend that promises to continue as the range and accuracy of space-derived data improves. Further, satellite data has important legal implications because it allows the fulfilment of international obligations to be monitored, and offers a powerful tool for dispute resolution. Accordingly, this book examines the use of satellite images for cases concerning human rights violations, since the multitude of humanitarian crises worldwide demonstrate that it is of the utmost importance to analyse how space law, policies and space-related applications could further support the implementation and monitoring of the observance of human rights, thus contributing to enhanced security and sustainable development. Over the past decade renewed interest in practical applications of Earth observations from space has coincided with and been fueled by significant improvements in the availability of remote sensing data and in their spectral and spatial resolution. In addition, advances in complementary spatial data technologies such as geographic information systems and the Global Positioning System have permitted more varied uses of the data. During the same period, the institutions that produce remote sensing data have also become more diversified. In the United States, satellite remote sensing was until recently dominated largely by federal agencies and their private sector contractors. However, private firms are increasingly playing a more prominent role, even a leadership role, in providing satellite remote sensing data, through either public-private partnerships or the establishment of commercial entities that serve both government and private sector Earth observation needs. In addition, a large number of private sector value-adding firms have been established to work with end users of the data. These changes, some technological, some institutional, and some financial, have implications for new and continuing uses of remote sensing data. To gather data for exploring the importance of these changes and their significance for a variety of issues related to the use of remote sensing data, the Space Studies Board initiated a series of three workshops. The first, "Moving Remote Sensing from Research to Applications: Case Studies of the Knowledge Transfer Process," was held in May 2000. This report draws on data and information obtained in the workshop planning meeting with agency sponsors, information presented by workshop speakers and in splinter group discussions, and the expertise and viewpoints of the authoring Steering Committee on Space Applications and Commercialization. The recommendations are the consensus of the steering committee and not necessarily of the workshop participants.
