Es gibt drei Wege, einen Konflikt zu losen: durch Urteil, Vertrag oder Vermittlung. Dem am Ende der Vermittlung stehenden moderierten Vertrag widmet sich Tim Husemann. Der vermittelnde Moderator hat ein in der Rechtsordnung einzigartiges Interesse am Vertragsschluss. Dieses bezieht sich namlich nicht auf einen bestimmten Vertragsinhalt, sondern nur darauf, dass uberhaupt ein Vertrag - gleich welchen Inhalts - geschlossen wird. Mit diesem Interesse geht eine systemische Gefahr fur die Einhaltung der Neutralitatsvorgaben einher. Die neutrale Vermittlung ist jedoch gerade Basis fur die erhohte Legitimation des moderierten Vertrags gegenuber dem bilateral ausgehandelten Vertrag. Der moderierte Vertrag ist daher vor einer (versteckten) Verletzung der Neutralitatspflicht des Moderators zu schutzen. Um diesbezuglich eine adaquate rechtliche Reaktion zu ermoglichen, entwickelt der Autor das Bewegliche System des moderierten Vertrages, das seine wesentlichen Wertungen enthalt.
